Pursuant to due call and notice thereof, as ecial meeting of the City
Council of the City of Plymouth, Minnesota, was field on tTte day of
October 23 1975 . The following members were preseit:

Councilmember Spaeth introduced the following Resolution and moved
its adoption:
RESOLUTION 78-695
APPROVAL OF REVISED SITE PLAN FOR VOLP CONSTRUCTION COMPANY FOR PPCPERTY AT THE
NORTHWEST CORNER OF 28TH AVENUE N. AND NIAGARA LANE:(A-750)
WHEREAS, Volp Construction Company received approval of a site plan for a 52,400
sq. ft. owner -occupied building through City Council Resolution 78-548; and.
WHEREAS, the site consisted of a 4k parcel designated proposed Lot 2, Block 1 of
the Volp Industrial Park for which preliminary plat approval was granted under
City Council Resolution 78-547; and
WHEREAS, petitioner desires to convey the site so that construction may commence
of the approved development, but finds that no less than a 5 acre parcel created
through statutory means can be conveyed until the approved plat is filed; and
WHEREAS, petitioner has expressed to the City that the filing of the plat will
not be possible for several months, pending the registration of the property
through torrens action which has been initiated; and
WHEREAS, expansion of the subject site to the west of one-half acre does not alter
the approved site plan except as to area;
NO:; THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does, approve the request of Volp Construction
Company for site plan approval of a 52,400 sq. ft. owner -occupied building located
on property at the northwest corner of 28th Avenue N. and Niagara Lane, specifically
described as the south 345 feet of the north 651 feet of the east 674.31 feet of
the east one-half of the southwest quarter of Section 21, T118, R.22 Hennepin County
Minnesota, subject to the following conditions:
1. Compliance with the provisions of the City Engineer's memorandum.
2. Outdoor storage of waste, waste containers, materials and products prohibited.
3. Dedication of a 7 ft. additional right-of-way for roadway purposes along
Niagara Lane -from 28th Avenue North to the north limits of the site.
4. Payment of Park Dedication fees -in -lieu of $4,250.00 (5 acres x $850 per acre).
5. Provisions of performance security per Zoning Ordinance requirements for
exterior improvements termed for 18 month;.
6. Design of that portion of pond BC -9 which affects this site shall be
specifically approved by the City Enqineer.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember N21;s , and upon vote being taken thereon, the
