HomeMy WebLinkAboutCity Council Resolution 1978-661i CITY OF PLY11OUTH • Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the . 16th day of October , 19 78. The following members were present: Mayor Hunt, Councilmembers Hoyt, Neils and Spaeth The following members were absent: Councilmember Seibold Councilmember Spaeth introduced the following Resolution and moved its adoption: RESOLUTION NO. 78-661 AMENDING DEVELOPMENT CONTRACT PLYMOUTH HILLS ADDITION (A-675) WHEREAS, the City Council adopted Resolution No. 78-532 on August 28, 1978 approving a Development Contract for Plymouth Wills Addition, and WHEREAS, it is recommended that the Contract be amended with regard to Park Dedication and Removal of Diseased Trees NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that Section 13.1 and Section 14.5 of the Development Contract be deleted and the following new Sections be included in their place: 13.1 The developer shall dedicate Outlots B, F and H to the City for public purposes upon the filing of the final plat. The dedication of these three outlots shall serve to meet the developer's park dedication requirements for Blocks 1, 2 and Outlot D of the plat. Park dedication requirements for Outlots A, C. E and G shall be satisfied in accordance with the City's park dedication policy in effect at the time of final platting of each of these outlots. Park dedication requirements are currently calculated on a per -dwelling -unit basis for residential projects while commercial projects have park dedication requirements calculated on an acreage basis. It is further understood that the development of Outlots A, C, E and G, as they abut Outlots B and F, may be required, as a condition of final platting, to dedicate additional lands for public purposes adjacent to said Outlots B and F, providing, however, that such additional dedication shall be credited against park dedication requirements. Park dedication requirements for Blocks 3, 4 and 5, with the exception of a portion of Lot 6 and all of Lot 7 of Block 5, were satisfied by the developer previously. Park dedication requirements for that portion of Lot 6 and all of Lot 7 of Block 5, which were sold to the developer by the City, shall be satisfied by the developer granting the City a trail easement, grading and landscaping the trail, in accordance with City specifications, alono the easterly side of Lot 7 from Highway 55 northerly to the underpass on the north side of 32nd Avenue North. 14.5 Removal of all diseased or dead trees from the site solely at developer's expense. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Hoyt , and upon vote being taken thereon, the followi ng voted In fayor thereof: Mayor Hunt, Councilmembers Hoyt, Neils and Spaeth rhe following voted against or abstained; None , Whereupon the Resolution was declared duly passed and adopted, i lk *;t t
