HomeMy WebLinkAboutCity Council Resolution 2020-316 CITY OF PLYMOUTH RESOLUTION NO. 2020-316 R ESOLUTION D ENYING C OMPREHENSIVE P LAN A MENDMENT TO R EGUIDE A PPROXIMATELY 156.8 A CRES FROM P-I TO LA-1 AND D ENYING R ELATED D EVELOPMENT A PPLICATIONS FOR THE F ORMER H OLLYDALE G OLF C OURSE S ITE (2020-056) WHEREAS, Hollydale GC Development, Inc. has requested a comprehensive plan amendment to reguide approximately 156.8 acres of land located at 4710 Holly Lane from P-I (public/semi- public/institutional) to LA-1 (living area-1); and WHEREAS, the land (Subject Property) affected by the reguiding and related development applications is legally described as follows: That part of Outlot D, Autumn Hills embraced within the Northeast Quarter of the Southeast Quarter of Section 8, Township 118, Range 22 lying westerly of the following described line; commencing at the northwest corner of Lot 16, Block 1, Autumn Hills 2nd Addition; thence southeasterly to the southwest corner of Lot 16, Block 1, Autumn Hills 2nd Addition and said line there terminating. AND Outlot D, Autumn Hills, EXCEPT that part embraced within the Northeast Quarter of the Southeast Quarter of Section 8, Township 118, Range 22, FURTHER EXCEPTING that part of Outlot D, Autumn Hills embraced within the Southeast Quarter of the Southeast Quarter of Section 8, Township 118, Range 22 lying westerly of the following described line; commencing at the northwest corner of Lot 16, Block 1, Autumn Hills 2nd Addition; thence southeasterly to the southwest corner of Lot 16, Block 1, Autumn Hills 2nd Addition and said line there terminating. AND The West half of the Southeast Quarter of Section 8, Township 118, Range 22, Hennepin County, Minnesota. That portion of Lot 2, Block 1, RNL Subdivision described as the North 52 feet of Lot 2, Block 1, and the South 146 feet of Lot 2, Block 1, according to the recorded plat thereof, Hennepin County, Minnesota. The Northeast Quarter of the Southwest Quarter of Section 8, Township 118, Range 22, Hennepin County, Minnesota, EXCEPTING the Soo Line Railroad right of way. The Southeast Quarter of the Southwest Quarter of Section 8, Township 118, Range 22, Hennepin County, Minnesota, EXCEPTING the following: Resolution 2020-316 (2020-056) Page 2 That portion of the Southeast Quarter of the Southwest Quarter of Section 8, Township 118, Range 22, platted as RNL Subdivision, Hennepin County, Minnesota. FURTHER EXCEPTING The West 175.00 feet of the South 275.00 feet of the Southeast Quarter of the Southwest Quarter of Section 8, Township 118, Range 22, Hennepin County, Minnesota. FURTHER EXCEPTING That part of the North 241.50 feet of the South 516.50 feet of the Southeast Quarter of the Southwest Quarter of Section 8, Township 118, Range 22, which lies westerly of the following described line: Beginning at a point on the North line of said South 516.50 feet distant 205.00 feet East of the Northwest corner of said South 516.50 feet; thence southerly to a point on the South line of said North 241.50 feet distant 191.00 feet east of the Southwest corner of said north 241.50 feet, and there ending, Hennepin County, Minnesota. AND Lot 1, Block 1, RNL Subdivision, Hennepin County, Minnesota. AND That part of Lot 2, Block 1, RNL Subdivision, Hennepin County, Minnesota, lying South of the North 52 feet, and North of the South 146 feet thereof, Hennepin County, Minnesota. WHEREAS, on October 21, 2020, the Planning Commission reviewed the request at a duly called public hearing and recommended denial; and WHEREAS, on November 10, 2020, the City Council reviewed the application and the complete record; and WHEREAS, On June 26, 2019 the Metropolitan Council found that the City’s updated Comprehensive Plan meets all Metropolitan Land Planning Act requirements: conforms to the regional system plans including transportation, aviation, water resources management, and parks; is consistent with Thrive MSP 2040; and is compatible with the plans of adjacent jurisdictions. Based on this Metropolitan Council determination, the City Council approved the update to the City’s Comprehensive Plan on July 23, 2019; and WHEREAS, State Statutes require the Comprehensive Plan be updated every 10 years. The process to update the Comprehensive Plan is involved and time consuming. The City published notification to all property owners of Plymouth and notified all surrounding communities, school districts and various state agencies of the proposed updates to the Comprehensive Plan, and 212763v2 Resolution 2020-316 (2020-056) Page 3 WHEREAS, the Subject Property has been guided public & semi-public since May of 1978 and public/semi-public/institutional since 1993. The City did not receive a request or feedback from the Applicant or Property Owner of the Subject Property requesting that the affected property be reguided LA-1 during the recent review and decennial update of the Comprehensive Plan; and WHEREAS, the City’s most recently adopted Comprehensive Plan continues to guide the Subject Property P-I; and WHEREAS, reguiding the Subject Property, which consists of 156.8 acres, from P-I to LA-1 is an intensification of use of the Subject Property that was not contemplated by the recently adopted Comprehensive Plan that was reviewed and approved by the Metropolitan Council and is inconsistent with the Plan as adopted; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does deny a Comprehensive Plan amendment to reguide roughly 156.8 acres of land located at 4710 Holly Lane from P-I (public/semi-public/institutional) to LA-1 (living area- 1), based on the analysis contained within staff memos and the exhibits attached to the aforesaid memos, all minutes from the above-mentioned meetings, all comments received by the public or applicant, and any and all other materials distributed at these meetings, and the record of the application reviews, which are hereby incorporated by reference. BE IT FURTHER RESOLVED, this resolution denies the related rezoning, preliminary plan, and subdivision code variance that was submitted for the former Hollydale Golf Course site, as those aspects of the development proposal and applications are inconsistent with the Comprehensive Plan guiding of the Subject Property as P-I and premature based on denial of the requested reguiding application.
