The following members were present: Mayor Hunt, Councilmen eters Hoyt, Seibold and Spaeth The following members were a semounce meli6n e—r-�eils Councilmember Spaeth introduced the following Resolution and moved Its adoption: RESOLUTION NO. 78- 613 A RESOLUTION RESCINDING RESOLUTION NO. 78-3S8 RELATING TO THE VACATION OF A PORTION OF LARCH LANE` WHEREAS, on the 22nd day of May, 1978 the City Council of the City of Plymouth adopted Resolution No. 78-318 receiving a petition for the vacation of a portion of Larch Lane and setting a date for a public hearing on such vacation and, WHEREAS, pursuant to such Resolution, a notice of a public hearing was published in the New Hope -Plymouth Post, the official newspaper of the City, a copy of which is attached hereto as Exhibit "A" and, WHEREAS, on the 19th day of June, 1978 such public hearing was held before the City Council after which the said Council did adopt Resolution No. 78-358 purporting to vacate a portion of said Larch Lane, a copy of which Resolution is attached hereto as Exhibit 'B" and, WHEREAS, said Resolution No. 78-358 was duly recorded in the office of the County Recorder of Hennepin County, Minnesota on July 12, 1978 as Document No. 4393607 and, WHEREAS, said Resolution 78-358 incorrectly and improperly described the portion of said Larch Lane to be vacated in that such description did not conform to the description contained in the notice of public heating and that therefore such resolution was illegal, unconstitutional and invalid, NOW, THEREFORE. -IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. Resolution No. 78-358 adopted June 19, 1978 is hereby rescinded and declared to be invalid and of no further force and effect. continued/ v' W Resolution N 78-613 Page 2 2. The City Clerk is directed to file and record a certified copy of this Resolution, with exhibits attached, with the County Recorder of Hennepin County, Minnesota.
