The following members were P►"esEnt: Spaeth The following members were absent: Councilmemher Nails �gyp�ilmembe�aeth introduced the following Resolution and movedd itssaaddopti,on: RESOLUTION 78-604 APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOR MISSION HILLS PARK FIFTH ADDITION PARTNERSHIP (A-338) WHEREAS, Mission Hills Park Fifth Addition Partnership has requested approval of the final plat for Mission Hills Park Fifth Addition a plat for 23 single-family lots and 2 outlots located west of Zachary Lane at 40th Avenue North, and a development contract therefor; and WHEREAS, Plymouth Planning Commission has reviewed said request and recommends its approval; and WHEREAS, the City Staff has prepared a development contract covering the improvements related to said plat; NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does, approve the request of Mission Hills Park Fifth Addition Partnership for final plat approval of Mission Hills Park Fifth Addition, a plat for 23 single-family lots and 2 outlots; FURTHER, that the development contract for such plat be approved and that the Mayor and City Manager be authorized to execute the development contract on behalf of the City subject to the following conditions: 1. Fee title transfer to the City of outlots A and B following grading, seeding, and sodding by the developer within 12 months of Council approval of the final plat and development contract. 2. Compliance with the conditions of the City Engineer's memorandum for this plat.
