Pursuant to due call and notice thereof, a special meeting of
the City Council of the City of Plymouth. Minnesota was held on the
26th day of m Pr. , 19_a. The following members were
present: Ma - or Hunt. Councilmembers Hoyt. Seibold and Spaeth
The following members were absent: Councilmember Nails
Mayor Hunt introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 78-602
UPHOLDING RULING OF BOARD OF ZONING ADJUSTMENTS AND DENYING VARIANCE REQUEST
BY ROBERT F. LINNELL - 9950 - 26TH AVENUE NORTH
WHEREAS, Robert F. Linnell requested a variance of 13 ft. from the City Zoning
Ordinance minimum sideyard setback standard to permit the location of a proposed
detached garage 2 ft. from the side lot line, rather than the ordinance minimum
setback of 15 ft; and
WHEREAS, the request was considered by the Board of Zoning Adjustment at a duly
called hearing on August 8, 1978 and was denied by the Board following the hearing
because no hardship was demonstrated in the request, said finding being confirmed
in the August 31, 1978 Board of Zoning Adjustments order; and
WHEREAS, the Petitioner has appealed the Board's decision to the City Council as
provided in the City Zoning Ordinance;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that it should and hereby does uphold the August 31, 1978 order of the
Board of Zoning Adjustments reflecting the action of the August 8, 1978 Board
hearing regarding the request by Robert F. Linnell, 9950 - 26th Avenue North
for a 13 ft. sideyard setback variance.
BE IT FURTHER RESOLVED that Robert F. Linnell shall be directed to locate his
garage in such a manner whereby it will meet the ordinance requirements in
existence at the time the house was built and will he in conformance with the
required 10 ft. sideyard setback.
The motion for the adoption of the foregoing Resolution was duly seconded by
and upon vote being taken thereon. the
