The following members were present: Acting Ma or Spaeth, Councilmembers Hoyt, _Ne_ils and Seibold f' -Fe- fol ow7ng members werea sem Mayor Hunt 1t�tir fir* � Councilmember Seibold introduced the following Resolution and moved a adoption: RESOLUTION NO. 78- 582 AUTHORIZING VACATION OF EASEMENT ON OUTLOT A, BEL14ARIS INDUSTRIAL PARK WHEREAS, a petition to vacate street, drainage and utility easement on Outlot A,. Belmar's Industrial Park has been received by the City Council of the City of Plymouth, and WHEREAS, the City Council did by Resolution No. 78-S40 determine that a Public Hearing on said Petition should be held on September 18, IF78 in accordance with Minnesota Statutes 412.851, and WHEREAS, a Notice of said Hearing was published and posted two weeks prior to said September 18, 1978 as required by law, and WHEREAS, it was determined by the City Council that said easements are not needed; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: The following described easements are hereby vacated: That part of Outlot A, BELMAR'S INDUSTRIAL PARK, Hennepin County, Minnesota, according to the recorded plat thereof, described as follows: Commencing at the southwest corner of said Outlot A, thence on an assumed bearing. of North along the west line of said Outlot A 297.89 feet; thence East 500.00 feet to the point of beginning; thence South 330.00 feet to the South line of said Outlot A; thence East along the South line of said Outlot A 322.40 feet to the southeast corner of said Outlot A; thence northeasterly 307.21 feet along the southeasterly line of said Outlot A and also being the westerly line of Cheshire Lane, to the most easterly corner of said Outlot A; thence North 89 degrees 58 minutes 21 seconds West along the north line of said Outlot A 234.07 feet to the angle point in said Lot line; thence North 0 degrees 16 minutes 09 seconds West along the east line of said Outlot A 24.11 feet to the intersection with a line that bears East from the point of beginning; thence West 117.43 feet to the point of beginning. A 10' permanen,t easement for drainage and storm sewer purposes over, under, across and through the west 10' of the above described property. and continued/ W W Resolution 0 78-582 Page 2 A permanent easement for street and utility purposes over, under, across and through that part of the above described property said permanent easement being described as follows: Commencing at the southeast corner of the above described property; thence Northeasterly 157.21' along the southeasterly line of said Out - lot A and also being the westerly line of Cheshire Lane to the actual point of beginning; thence Northeasterly 150' along the southeasterly line of said Outlot A and also being the westerly line of Cheshire Lane to the most easterly corner of Outlot A; thence North 89 degrees 53 minutes 21 seconds West a distance of 60 feet along the north line of said Outlot A; thence southeasterly to the point to beginning; there terminating and A 10' permanent easement for drainage and storm sewer purposes over, under, across and through that part of the above described property, the centerline of said permanent easement being described as follows: commencing 51 south of the north- west corner of the above described prpperty; thence east 112.43 feet; thence south 0 degrees 16 minutes 09 seconds a distance of 24.11 feet; thence South 80 degrees 53 minutes 21 seconds East a distance of 239 feet more or less to a point 5' South of the most easterly corner of Outlot A, there terminating.
