Pursuant to due call and notice thereof, a special meeting of
the City Council of the City of Plymouth, Minnesota was held on the
28th day of August , 1978 . The following members were
present: Mayor Hunt Coungilmembers Hoyt Neils and Spaeth
The following members were absent: Councilmember Seibold
Councilmember Spaeth introduced the following Resolution and
moved its adoption:
RESOLUTION #78- 539
ORDERING PUBLIC HEARING ON THE PROPOSED STREET VACATION ON
NIAGARA LANE, NORTH OF 23RD AVENUE
WHEREAS, pursuant to M.S.A 414.851, the city is considering the vacation of the
following street right-of-way:
That portion of Niagara Lane described as follows: commencing at the south-
west corner of Lot 9, Blk. 1, Circle Star Business Center, First Addition
which is also on the east line of Niagara Lane; thence north along said
right-of-way line, 1189.32 feet; thence southwesterly to a point 20 feet
west and 742.74 feet north of the southwest corner of said Lot 9; thence south
along a line parallel with and 20 feet west of the east line of Niagara Lane to
the north line of 23rd Avenue; thence east to the point of beginning. The
city reserves an easement for sewer and water purposes over the entire tract
of land.
WHEREAS, the City Council has reviewed said proposed vacation and found the
same to be in order.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA that it should and hereby does -establish the date of
September 18, 1978, at 7:30 p.m. at the Council Chambers, Public Works
Building, as the time and place for the public hearing on said petition, and
directs the administrative staff to publish notice of said hearing as provided
by law.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Neils , and upon vote being taken thereon, the
following vote In fayor thereof: Mayor Hunt, Councilmembers Hoyt,
Neils and Spaeth
The following voted against orabstained; None ,
Whereupon the Resolution was declared duly passed and adopted.
