The following members were present: Mayor Hunt.Councilmembers Neils and Spaeth The following members were absent: Councilmembers Seibond and Hoyt Councilmember Spaeth introduced the following Resolution and moved its adoption: RESOLUTION #78- 519 APPROVING CONDITIONAL USE PERMIT FOR DAY CARE CENTER FOR ST. MARY'S OF THE LAKE CHURCH (KATHLEEN DAYTON) (A-503) WHEREAS, Kathleen Dayton, on behalf of St. Mary's of the Lake Catholic Church, has requested a conditional use permit to operate a day care center from rooms 206, 207 and 208 of the school of St. Mary's of the Lake Catholic Church located in the southwest quadrant of Forestview Lane and 3rd Avenue North; AND, WHEREAS, the Planning Commission has reviewed said request and recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should, and hereby does, approve the request of Kathleen Dayton on behalf of St. Mary's of the Lake Catholic Church for a conditional use permit to operate a day care center from rooms 206, 207, and 208 of the school of St. Mary's of the Lake Catholic Church located in the southwest quadrant of Forestview Lane and 3rd Avneue North, subject to the following conditions: 1. The permit is issued to the applicant as operator of the facility and is not transferable. 2. The permit is subject to all applicable codes, regulations (including special State licensing requirements) and ordinances, and violations thereof, shall be grounds for revocation. 3. Issuance of the permit shall be subject to receipt of written approval and endorsement by the appropriate State Agency, and a copy of the current State operating license shall be kept on file with the City. 4. The facility shall be limited to not more than 54 children, and the use of room numbers 206, 207, and 208. 5. The permit shall be for a one year period. The motion for the adoption of the foregoing Resolution was duly seconded by CQWpcilmember Neils "and upon vote being taken thereon, the 0 ]owing voted n favor Me reo ; Mayor Hunt, Councilmenbers Neils and Spaeth The following vote against orabstained; . None Whereupon the Resolution was declared duly passed and ad6ptid.
