Pursuant to due call and notice thereof, a regular meeting of
the City Council of the City of Plymouth, Minnesota washe-7-5-5—Te

Councilmember Spaeth introduced the following Resolution and
move is adoption:
RESOLUTION NO. 78-514
AUTHORIZING VACATION OF A PUBLIC RIGHT -OF WAY IN LOT 3, BLOCK 4,
MINNEAPOLIS INDUSTRIAL PARK 2ND ADDITION (A-794)
WHEREAS, a petition to vacate a portion of old East Street as platted in the
old plat of Parker's Lake Gardens (now part of Lot 3, Block 4, Minneapolis
Industrial Park 2nd Addition) has been received by the City Council of the
City of Plymouth, and
WHEREAS, the City Council did by Resolution No. 78-471 determine that a
public hearing on said petition should be held on August 21, 1978 in accordance
with Minnesota Statutes 412.851, and
WHEREAS, a notice of said hearing was published and posted two weeks prior
to said August 21, 1978 as required by law, and
WHEREAS, on August 21, 1978 a public hearing was held at which time all persons
interested in said proposed vacation were given an opportunity to be heard, and
WHEREAS, it was determined by the City Council that said public right-of-way
is not needed for street or other purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA as follows:
1. That the east 60 feet of Lot 3, Block 4, Minneapolis Industrial Park
2nd Addition (formerly known as East Street as platted in the old plat
of Parker's Lake Gardens) is hereby vacated as a public right-of-way.
2. That said vacation shall not affect the authority of any person, corporation
or municipality owning or controlling electric or telephone poles and lines,
gas and sewer lines, or water pipes, mains and hydrants thereon or thereunder,
to continue maintaining the same or to enter upon such way or portion thereof
vacated to repair, replace remove or otherwise attend thereto.
The motion for the adoption of the foregoing Resolution was duly seconded by
and upon vote being taken thereon, the
