Were a Seibold and Spaeth iDe following rs sent: NnnP e+e• est **e Spaeth introduced the following Resolution and moved its adoption: RESOLUTION NO. 78-507 CORRECTING EASEMENT FOR METROQUIP - 23RD & FERNBROOK LANE WHEREAS, George A. Jackson & Associates, Inc. did on the third day of April, 1978 execute and deliver an easement to the City of Plymouth for street and utility purposes which easement was described as follows: A permanent easement for street and utility purposes over, under, across and through the east 40 feet of the following described property which lies east and adjacent to the centerline of Fernbrook Lane: The South one-half of the Southwest Quarter of the Northwest Quarter of the Northwest Quarter of Section 27, Township 118, Range 22, West of the Fifth Principal Meridian, Hennepin County, Minnesota, also A permanent easement for street and utility purposes over, under, across and through the South 30 feet of the above described property, and WHEREAS, said easement was duly recorded and filed for record on the tenth day of April, 1978 as Document No. 4368503 in the Office of the County Recorder of Hennepin County, Minnesota, and WHEREAS, said easement description was incorrect and did not convey the easement intended, and WHEREAS, it is necessary ghat the City of Plymouth reconvey said easement to said George A. Jackson & Associates, Inc. and receive from said corporation a new instrument correctly describing the easement to be conveyed; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that: 1. The Mayor and City Clerk are hereby authorized and directed to execute a Quit Claim Deed to George A. Jackson & Associates, Inc. conveying the following described property to said corporation: The east 40 feet of the following described property which lies east and adjacent to the centerline of Fernbrook Lane: Resolution #78-507 Page 2 The South one-half of the Southwest Quarter of the Northwest Quarter of the Northwest Quarter of Section 27, Township 118, Range 22, West of the Fifth Principal Meridian; Hennepin County, Minnesota, also The South 30 feet of the above described property. 2. The City Clerk is authorized and directed to deliver a certified copy of this resolution to George A. Jackson & Associates, Inc.
