RESOLUTION NO. 78-486
CANCELLING HEARING ON IMPROVEMENT PROJECT NO. 702
23RD AVE., 25TH AVE. AND CHESHIRE LANE
WHEREAS, the resolution of the City Council adopted July 31, 1978 fixed the date
for the following public improvement:
1. 25th Avenue from Fernbrook Lane to Cheshire Lane
2. 23rd Avenue from Fernbrook Lane to Cheshire Lane
3. Cheshire Lane from 25th to 23rd Avenues
4. Cheshire Lane (Easement) from 23rd Avenue to approximately 260 feet (ft.)
South of 21st Avenue
By the installation of sanitary sewer, watermain, storm sewer and 9 -ton bituminous
streets with concrete curb and gutter (on Cheshire Lane Easement - from 23rd
Avenue to approximately 260 feet South of 21st Avenue - watermain only), and all
necessary appurtenances, and
WHEREAS, the City Council has subsequently received a petition from the property
owners owning property abutting the aforementioned improvements, which petition
requests that the City Council proceed with the installation of the public improve-
ment as noted, and,
WHEREAS, said petitioners have waived their right to a public improvement hearing
previously scheduled for August 14, 1978 with respect to this project and to
consent to the City Council moving ahead with the program as petitioned.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLvMOUTH,
MINNESOTA;
1. The public hearing scheduled for August 14, 1978 is herewith cancelled.
The motion for the adoption of the foregoing Resolution was duly seconded by
Cour,cilmember Spaeth , and upon vote being taken thereon, the

Spaeth
