The following members were present: Morro} +Hunt, ounce Members Hoyt, Neils and Seibold The following members were absent: _ Counci"lMeMDe Spaeth x� t** Councilmember Seibold introduced the following Resolution and moved s adoption: - RESOLUTION #78- 469 APPROVING VARIANCE ACTION FROM SUBDIVISION ORDINANCE REQUIREMENT FOR PROPERTY ABUTMENT TO A PUBLIC STREET AS A CONDITION OF BUILDING PERMIT ISSUANCE IN NON-SEWERED AREAS OF THE CITY WHEREAS, Section 9.02 of Chapter VII of the City Code prohibits the construction of buildings or structures and the issuance of building permits for buildings or structures on parcels which are 300 ft. in width or more, and five acres in area or more, unless such parcels are abutting on a public street; and, WHEREAS, the City Council, at its July 24, 1978 meeting, reviewed file A-842 submitted by Messrs. James Schweigert and Robert•Ledin requesting a variance from said section of the Subdivision Ordinance in consideration of nine parcels divided per State Statute which are located westerly of Juneau Lane at approximately 56th Avenue North, and which are 300 ft. or more in width and which are five acres or more in area; and, across which an easement for private access has been established extending from Juneau Lane; and, WHEREAS, the City administratively in October 1976, Grading Permit #127 for the construction of a private road and installation of culverts along said private easement; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that it should and hereby does approve a variance from Section 9.02 of Chapter VII of the City Code, authorizing the issuance of building permits for single family dwellings on the following described nine parcels, subject to the following conditions: 1. Granting of this waiver does not necessarily constitute approval of the alignment of the easement with respect to possible future ppublic roadwayy dedication, nor incur on behalf of the City any responsibility dor ma ntenance; 2. Appropriate perpetual access easements, as approved by the City Attorney, providing access across the respective properties to the approved intersection with Juneau Lane, are filed prior to issuance of the,buildinq permits. Parcel 1 The West 327 feet of the east 1014 feet of that part of Government Lot 2, Section 4, Township 118, Range 22, Hennepin County, Minnesota, lying north of a line drawn east from a point in the west line of said Lot 2 distant 668.62 feet south of the Northwest corner thereof, to a point in the east line of said Government Lot 2 Resolution #78- 469 Page 2 distant 666.63 feet south of the northeast corner thereof. Subject to and together with the road easements provided in Document No. 1195249 and Document No. 1203940. Parcel 2 That part of Government Lot 2, Section 4, Township 118, Range 22, Hennepin County, Minnesota, lying west of the east 1014 feet thereof, and lying north of a line drawn east from a point in the west line of said Lot 2 distant 668.62 feet south of the northwest corner thereof, to a point in the east line of said Government Lot 2 distant 666.63 feet south of the northeast corner thereof. Also, the east 22 feet of the North Half of the Northeast Quarter of the Southwest Quarter of said Section 4. Subject to and together with the road easements provided in Document No. 1195249 and Document No. 1203940. Parcel 3 The West 327 feet of the east 349 feet of the North Half of the Northeast Quarter of the Southwest Quarter of Section 4, Township 118, Range 22, Hennepin County, Minnesota. Subject to and together with the road easements provided in Document No. 1195249 and Document No. 1203940. Parcel 4 The West 327 feet of the east 676 feet of the North Half of the Northeast Quarter of the Southwest Quarter of Section 4, Township 118, Range 22, Hennepin County, Minnesota. Subject to and together with the road easements provided in Document No. 1195249 and Document No. 1203940. Parcel 5 The North Half of the Southeast Quarter of the Northeast Quarter of the Southwest Quarter of Section 4, Township 118, Range 22, Hennepin County, Minnesota. Subject to and together with the road easements provided in Document No. 1195249 and Document No. 1203940. Parcel 6 The South Half of the Southeast Quarter of the Northeast Quarter of the Southwest Quarter of Section 4, Township 118, Range 22, Hennepin County, Minnesota. Subject to and together with the road easements provided in Document No. 1195249 and Document No. 1203940. Parcel 7 The South Half of the Southwest Quarter of the Northeast Quarter of the Southwest 1W IW Resolution # 78- 469 Page 3 Quarter of Section 4, Township 118, Range 22, Hennepin County, Minnesota. Subject to and together with the road easements provided in Document No. 1195249 and Document No. 1203940. Parcel 8 The North Half of the Southwest Quarter of the Northeast Quarter of the Southwest Quarter of Section 4, Township 118, Range 22, Hennepin County, Minnesota. Subject to and together with road easements provided in Document No. 1195249 and Document No. 1203940. Parcel 9 That part of the North Half of the Northeast Quarter of the Southwest Quarter of Section 4, Township 118, Range 22, Hennepin County, Minnesota, lying west of the east 676 feet thereof. Subject to and together with the road easements provided in Document No. 1195249 and Document No. 1203940.
