HomeMy WebLinkAboutCity Council Resolution 2009-218CITY OF PLYMOUTH RESOLUTION N0. 2009-218 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT AND VARIANCE FOR STONE SOURCE TO ALLOW ACCESSORY RETAIL SALES AT 15831 STATE HIGHWAY 55 (2009040) WHEREAS, Stone Source has requested approval of a conditional use permit and variance to allow accessory retail sales for property legally described as follows: Lot 3, Block 1, Playhouse Industrial Park, except that part of the west 484.96 feet of said Lot 3 which lies southerly of a line running from a point in the east line of the west 484.96 feet of said Lot 3 therein distant 160.00 feet north of the south line of said Lot 3 to a point in the west line of said Lot 3 therein distant 210.00 feet north of the southwest corner of said Lot 3; WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Stone Source for a conditional use permit and variance for property located at 15831 State Highway 55, subject to the following conditions: 1. The conditional use permit requested to allow accessory retail sales is approved, in accordance with the plans received by the City on July 23, 2009, except as may be amended by this resolution based on the finding that all applicable conditional use standards have been met. 2. The variance requested to allow accessory retail sales in 13,890 square feet (18 percent of the tenant space) is approved, based on the finding that all applicable variance standards have been met. 3. Within 30 days of approval, all signage on the site shall comply with Section 21155 of the Zoning Ordinance and the applicant shall plant nine trees to replace the nine removed. 4. Trash receptacles shall be stored in locations consistent with Section 21120.08 of the Zoning Ordinance. 5. The approval is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. Resolution 2009-218 (2009040) Page 2 6. The conditional use permit and variance shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21015.07 and 21030.06 respectively, of the Zoning Ordinance.
