The following members were present: Acting Mayor Rpaath_- rnunrilmemhPrs Nails and Seihnld The follow ni g members were" absent: _ Mayer Hunt and CnuncilmemhPr Hoyt_• Councilmembgr Seibold introduced the following Resolution and moved Its adoption: RESOLUTION #78-409 APPROVING CONDITIONAL USE PERMIT AMENDMENT FOR FOX MEADOWS PLANNED BUSINESS DEVELOPMENT AND SITE PLAN FOR ST. LOUIS PARK MEDICAL CENTER (A-467) WHEREAS, St. Louis Park Medical Center has requested conditional use permit amendment to the Planned Business Development for Fox Meadows and a site plan for a 14,635 sq. ft. structure for a medical clinic, proposed to be located at Harbor Lane and approximately 30th Avenue North; and, WHEREAS, the Planning Commission has reviewed said request and recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should, and hereby does, approve the requests of the St. Louis Park Medical Center for conditional use permit amendment to the Planned Business Development for Fox Meadows and a site plan for a 14,635 sq. ft. structure for a medical clinic, proposed to be located at Harbor Lane and approximately 30th Avenue North, subject to the following conditions: 1. Completion of the let division/consolidation procedures including filing with with Hennepin County, prior to building permit issuance. 2. Compliance with the previsions of the City Engineer's memorandum. 3. Payment of Park Dedication fees -in -lieu of $2,550 (3 acres X $850 per acre). 4. Provision of bond guaranteeing landscaping and private improvements, termed for 18 months. 5. No outside storage be allowed for the use. 6. Elimination of one parking space to avoid variance for parking setback to the east property line. 7. Landscape stock be of the following dimensions at a minimum: coniferous trees be 5 ft. in height, balled and burlapped and deciduous trees be 2'Z" calipher. 8. Prior to development of Phase II, the expansion shall be reviewed and approved by the City with the intent of evaluating the capacity of on-site parking. 9. Prior to Conditional Use Permit becoming effective or issuance of building permits, petitioner shall supply evidence of consolidation of Parcel 2400 and residual of Parcel 2100. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Npils 'and upon vote being taken thereon. the ow ng voted n favor thereof Acting Mayor Spaeth.
