Pursuant to due call and notice thereof, a special meeting of the City
Council of the City of Plymouth. Minnesota. was a on a 10th day of

RESOLUTION NO. 78-403
ORDERING FINAL PLANS AND SPECIFICATIONS FOR IMPROVEMENTS
FOR 23RD 8 25TH AVENUES AND WATERNAIN IMPROVEMENTS FOR
CHESHIRE LANE' FROM 23RD ii 21ST AVENUE
WHEREAS, a resolution of the City CoL-tcil adopted June 26, 1978 fixed the date
for t+e following public improvements:
1. 25th Avenue from Fernbrook Lane to Cheshire Lane;
2. 23rd Avenue from Fernbrook Lane to Cheshire lane;
3. Cheshire Lane from 25th to 23rd Avenues;
4. Cheshire Lane (easement) from 23rd Avenue to approximately
260 ft. south of 21St Avenue
by the installation of sanitary sewer, water main. storm sewer and 9 -ton
bituminous streets with concrete curb and gutter (on Cheshire Lane easement -
from 23rd Avenue to approximately 260 ft. south of 21st Avenue - watermain only),
and all necessary appurtenances, and
WHEREAS, the City Council has subsequently received a petition from the property
owners owning property abutting the aforementioned improvements, which petition
requests that the Council proceed with the installation of the public improve-
ments as noted, with the exception of the construction of Cheshire Lane from
25th to 23rd Avenues, and
WHEREAS, said petitioners have waived their right to a public improvement
hearing previously scheduled for August 7. 1978 with respect to this project
and to consent to the City Council moving ahead with the program as petitioned;
NOW. THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH
MINNESOTA:
1. Such improvement is hereby ordered as proposed in Council Resolution
No. 78-393, adopted June 26, 1978, with the deletion of Cheshire Lane
from 25th to 23rd Avenues;

2. Bonestroo, Rosene. Anderlik 3 Associates, Inc. is hereby designated
as the engineer for this improvement. He shall prepare plans and
specifications for the making of such improvement which shall include
the street design on a 9 -tun. 40 ft. wide, with concrete curb and
gutter. The watermain construction shall consist of a 16" trunk
watermain on 23rd Avenue from Fernbrook Lane to Cheshire Lane and
on Cheshire Lane from 23rd Avenue to approximately 260 ft. south of
21st Avenue.
The motion for the adoption of the foregoing Resolution was duly seconded
by Council member Neils . and upon vote being talo thereon, the
