RESOLUTION No. 2009-213
A RESOLUTION DECLARING ADEQUACY OF PETITION AND ORDERING PREPARATION OF
PRELIMINARY ENGINEERING REPORT FOR STREET LIGHTING LOCATED AT
PLYMOUTH MIDDLE SCHOOL - 10011 36TH AVENUE
WHEREAS, a petition has been received from Robbinsdale Independent School District
No. 281, requesting installation of an overhead street light on a wood pole at 10011 36th Avenue;
and
WHEREAS, a certain petition requesting the improvement of 36th Avenue by the
installation of an overhead street light, filed with the City Council on September 8, 2009, is
hereby declared to be signed by the required percentage of properties affected thereby. This
declaration is made in conformance with Minnesota Statutes Section 429.035; and
WHEREAS, The petition is signed by Gary Hauan, Director of Finance for Robbinsdale
Independent School District No. 281 on behalf of Robbinsdale Independent School District No.
281 and has waived their rights to public improvement and special assessment hearings; and
WHEREAS, The petition is hereby referred to the City Engineer and he is instructed to
report to the City Council with all convenient speed advising the Council in a preliminary way as
to whether the proposed improvement is feasible and as to whether is should best be made as
proposed or in conjunction with some other improvement and the estimated cost of the
improvement as recommended.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA: That the petition requesting the street light has
been accepted along with ordering a preliminary engineering report for the street light located at
10011 36th Avenue.
