The following members were _ present: The following members were absent: Nan Counciimember Spaeth introduced the following Resolution and noved its adoption: U. SOLUTION 478- 386 APPROVING AMENDMENT TO CONDITION #17 OF SITE PLAN RESOLUTION #78-2 APPROVING SITE PLAN FOR "SUNRISE POINT" FOR CHOWEN INVESTMENT AT TIP OF THE LITTLE PENINSULA ON MEDICINE LAKE (A-186) WHEREAS, petitioner has requested amendment to Condition #17 of Resolution #78-2, approving a site plan for "Sunrise Point" for Chowen Investment, specifically "All above conditions shall be accomplished, all fees paid, a building permit issued and structural work commenced by July 1, 1978, or this action shall become null and void"; and. WHEREAS, circumstances exist beyond petitioner's control which make a commencement date of July 1, 1978 for the project unrealistic; NOW, THEREFORE, BE IT HEREBY RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLYMOUTH, .MINNESOTA, should, and hereby does direct that said condition #17 of Council Resolution #78-2 be amended to read as follows: "All above conditions shall oe accomplished, all fees paid, a building permit issued and structural work commenced by January 15 1979 , or this action shall become mill and void, and in the case of significant delays beyond the control of the developer, provide for Council review in six-month increments of time." BE IT FURTHER RESOLVED that since delays have been incurred through no fault of and beyond the control of the City, this site plan shall be subject to further review by the Planning Commission and consideration by the City Council prior to issuance of building permits exclusively for the purposes of (1) assuring conformance with City Ordinance amendments which became effective more than 180 days prior to the prospective date of issue of building permits and (2) assuring conformance with site plan conditions legally imposed by other jurisdictions.
