The following members were present: Spaeth The follow ng m -e ers were a sent: Councilmember Seibold Councilmember Spaeth introduced the following Resolution and moved its adoption: RESOLUTION #78- 369 APPROVING SITE PLAN AND CONDITIONAL USE PERMIT FOR OUTDOOR STORAGE IN I-1 ZONE FOR MUDCAT (A-826) WHEREAS, Mudcat has requested site plan approval for a 19,200 sq. ft. structure and a conditional use permit for outdoor storage of Mudcat dredging equipment, proposed to be located in the northeast quadrant of Niagara Lane and 28th Avenue North; and, WHEREAS, the Planning Commission has reviewed said request and recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should, and hereby does, approve the request of Mudcat for site plan approval of a 19,200 sq. ft. structure and a conditional use permit for outdoor storage of Mudcat dredging equipment, proposed to be located in the northeast quadrant of Niagara Lane and 28th Avenue North, subject to the following conditions: 1. Compliance with the provisions of the City Engineer's memorandum. 2. Payment of Park Dedication fees -in -lieu of $3,264. 3. The entire storage area shall not encroach the 50 ft. setback from Highway 55. 4. Provision of bond guaranteeing landscaping and private improvements for 18 months. 5. Elevation of the berm shall be increased from 976 to 978 and the landscape treatment shall include extension of the berm along the west side of the project at the same elevation as the berm to the north and east and continuation of the landscape stock. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Neils , and upon vote being taken thereon, the following vote n favor thereof: Mayor Hunt_ Councilmemberc_ Hoyt, Neils The 0 ow ng vote aga ns orabstained-, Whereupon the Resolution was declared duly paSsed and adopted,
