The following members were present: Mayor Hunt Councilmembers Hot Neils and Spaeth The following members were absent: Councilmember Seibold Councilmember Spaeth introduced the following Resolution and moved its adoption: RESOLUTION n78-358 AUTHORIZING VACATION OF LARCH LANE BETWEEN THE SOUTH LINE OF 24TH AVENUE NORTH AND THE NORTH LINE OF 23RD AVENUE NORTH (A-807) WHEREAS, a petition to vacate Larch Lane between the south line of 24th Avenue North and the north line of 23rd Avenue North has been received by the City Council from the property owners adjacent to Larch Lane between the south line of 24th Avenue North and the north line of 23rd Avenue North; and, WHEREAS, a public hearing with respect to said vacation was held on June 19, 1978 in accordance with Minnesota Statutes, 412.851, as amended; and, WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of June 19, 1978; and, WHEREAS, the Council did hold a public hearing on June 19, 1978 to inform any and . all interested parties relevant to the vacation of Larch Lane between the south line of 24th Avenue North and the north line of 23rd Avenue North; and, WHEREAS, it was determined by the City Council that that portion of Larch Lane is not needed for a public street; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, as follows: 1. That that portion of Larch Lane between the south line of 24th Avenue North and the north line of 23rd Avenue North be vacated as public roadway. 2. That said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling electric or telephone poles and lines, gas and sewer lines, or water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to repair, replace, remove or otherwise attend thereto. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Hoyt , and upon vote being taken thereon, the following vote n favor thereof, Mayor Hunt, Councilmembers Hoyt & Spaeth The following vote against arxs seta Councilmember Neils Whereupon the Resolution was declared duly p&Ased and a pie .
