The following members were present: owing members were absent: Councilmember Spaeth introduced the following Resolution and moved Its a op ion: RESOLUTION NO. 78- 256 ADOPTING ASSESSMENT CIMARRON EAST PROJECT NO. 851 WHEREAS, in conformance with the Development Contract, we fiave received a Waiver of Assessment Hearing from the property owner of Cimarron East (Plat 43728 Parcels 1010, 2260 and 3550) waiving his right to special assessment hearings covering the installatira of sanitary sewer and watermain laterals, trunk facilities and all other appurtenances. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assess- ment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of five (5) years, the first of the installments to be payable on or before the first Monday in January 1979 and shall bear interest at the rate of 8% per annum from the date of adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1979. To each subsequent install- ment, when due, shall be added interest on one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Finance Director, pay the whole of the assess- ment on such property with interest accrued to the date of payment to the City Treasurer, except that no interest shall be charged if the entire assess- ment is paid within 30 days from the adoption of this resolution; and he may, at any time thereafter pay to the City Finance Director the entire amount of the assessment remaining unpaid with interest accrued to December of the year in which such payment is made. 4. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Finance Director to be extended on the proper tax lists of the k - Resolution # 78-256 Page 2 County and such assessments shall be collected and paid over in the same manner as other municipal taxes. 5. The total cost of the improvement assessed by this resolution is $83,341.80.
