The following members were present: r Coun ilme ers Hot Neils Seibold and Spaeth The o owing members were absent: one Coyncilmember Si3aeth introduced the following Resolution and moved iC4­ adoption: RESOLUTION #78-248 APPROVING MULTIPLE PLANNED UNIT DEVELOPMENT (MPUD) 78-1 FOR CRITERION HOMES FOR CONCEPT PLAN (A-814) WHEREAS, Criterion Homes has requested Concept Plan approval of Multiple Planned Unit Development (MPUD) 78-1, consisting of residential, commercial and industrial uses on property located in the southeast quadrant of Fernbrook Lane and County Road 9; and, WHEREAS, the Planning Commission has reviewed said request and recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED -BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should, and hereby does, approve the request of Criterion Homes for Concept Plan approval of MPUD 78-1, consisting of residential, commercial and industrial uses on property located in the southeast quadrant of Fernbrook Lane and County Road 9, per plans Staff -dated April 13, 1978, subject to the following condi- tions: 1. Written consent of the owner of Plat 43722, Parcel 4115 as to design for the proposal as it affects his property at the southwest portion of the proposal. 2. Maximum affirmative design efforts toward on-site transition of the commercial and motel uses to the homes and lots of the Berthiume Addition. 3. Affirmative design efforts to buffering the trail from the single family detached dwellings by a combination of distance and plantings. Routing of the trail shall be between the existing single family residences and the proposed motel -fast-food area of the proposal. 4. Rerouting of the access road from County Road 9 to be between the existing single family and the proposed motel -fast-food area. 5. Temporary access to the industrial site be the same as the permanent access, relocating the access north 150 ft. 6. No building in any of the commercial or industrial areas of the project shall be greater than two stories in height. 7. Right-of-way dedication for the property of those residents fronting County Road 9 to allow for access to an alternate roadway at such time as County Road 9 is upgraded. Resolution g 78-248 Page 2 8. Lots at the north end of the project, abutting the existing single family lots, be 14,500 sq. ft. minimum. Further, that the minimum depth of the lots abutting the existing single family lots, be 145 ft. to allow for plantings and berming as was proposed as a buffer by petitioner. 9. One of the commercial structures located at the northeast corner of the proposal be eliminated (either the motel, a fast-food use or the convenience store). 10. At the next stage of development, owner of the property located at the southwest portion of the site, Plat 43715, Parcel 830, be contacted personally as to his reaction to the proposal and as to possible inclusion in the overall project.
