The following members were present: Hunt C unqilmembers The follow ng me ers were absent: ane _ Councilmember Spaeth introduced the following Resolution and moved its adoption: RESOLUTION NO. 78-243 DECLARING ADEQUACY OF PETITION AND ORDERING PREPARATION OF REPORT ON NATHAN LANE - SOUTH OF 10TH AVENUE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: WHEREAS, the City Council had received a certain petition requesting the improvement of 6th Avenue from CSAH 18 Service Drive to Nathan Lane, 8th Avenue from CSAH 18 Service Drive to Nathan Lane and Nathan Lane from 10th Avenue to 6th Avenue by the installation of sanitary sewer, watermain, curb and gutter and 10 -ton design bitum- inous streets, filed with the Council on October 5, 1976, is hereby declared to be signed by the required percentage of owners of property affected thereby. This declaration is made in conformance to Minnesota Statutes Section 429.035, and WHEREAS, the petition was referred to Bonestroo, Rosene, Anderlik & Associates, Inc. and they presented a preliminary engineering report, and WHEREAS, a public hearing was held on March 21, 1977 and the Council did not order any of the improvements, and WHEREAS, a petition was received for 9 -ton bituminous street improvement with concrete curb and gutter on Nathan Lane from 10th Avenue to 465 feet south, NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: The petition is hereby referred to Bonestroo, Rosene, Anderlik & Associates, Inc. and he is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is feasible and as to whether it should best be made as proposed or in connection with some other improvement and the estimated cost of the improvement as recommended. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Neils , and upon vote being taken thereon. the following vote n favor there Mayor Hunt Counciimembers H9vt_, Neils. Seibold and Spaeth-, The following vote against orabstained; Non Whereupon the Resolution was declared duly passed and adopted. irir+
