CITY OF PLYMOUTH
Pursuant to due call and notice thereof, aire ullaar meeting of the City
Council of the City of Plymouth, Minnesota, was held on on e 17th day of
April , 19 78 . The following members were present: Mayor Hunt,

Councilmember Neils introduced the following Resolution and moved
is adoption:
RESOLUTION NO. 78-201
ADOPTING ASSESSMENT
PALMER CREEK ESTATES 4TH ADDITION
PROJECT NO. 848
WHEREAS, in conformance with the Development Contract, we have received a Waiver
of Assessment Hearing from the property owner of Palmer Creek Estates 4th Addition
waiving his right to special assessment hearings covering the installation of
sanitary sewer and watermain facilities, trunk and all other appurtenances,
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:
1. Such proposed assessment, a copy of which is attached hereto and made a part
hereof, is hereby accepted and shall constitute the special assessment against
the lands named therein and each tract of land therein included is hereby -
found to be benefited by the proposed improvement in the amount of the
assessment levied against it.
2. Such assessment shall be payable in equal annual installments extending over
a period of five (5) years, the first of the installment to be payable on or
before the first Monday in January 1979 and shall bear interest at the rate of
8% per annum from the ddte of adoption of this assessment resolution. To the
first installment shall be added interest on the entire assessment from the
date of this resolution until December 31, 1979. To each subsequent install-
ment, when due, shall be added interest on one year on all unpaid installments.
3. The owner of any property so assessed may, at any time prior to certification
of the assessment to the County Finance Director. pay the whole of the assess-
ment on such property with interest accrued to the date of payment to the
City Treasurer, except that no interest shall be charged if the entire assess-
ment is paid within 30 days from the adoption of this resolution; and he may.
at any time thereafter pay to the City Finance Director the entire amount
of the assessment remaining unpaid with interest accrued to December of the
year in which such payment is made.
4. The Clerk shall forthwith transmit a certified duplicate of this assessment
to the County Finance Director to be extended on the proper tax lists of the
County and such assessments shall be collected and paid over in the same
manner as other municipal taxes.

5. The total cost of the improvement assessed by this resolution is $5,000.00
(water area = $2,500.00, sewer area = $2,500.00).
6. The breakdown shall be as follows:
Plat 44372 Parcel 8000 $1250.00 sewer, $1250.00 water
Plat 44371 Parcel 9000 $1250.00 sewer, $1250.00 water
The notion for the adoption of the foregoing Resolution was duly seconded
