Pursuant to due call and notice thereof, a reaular meeting of
the City Council of the City of Plymouth, Minnesota wasewe
17th day of A 19�. The following members were
present: Ma or Hunt, Counci members Hot Neils Seibold and Spaeth
The following members were absent: None
Councilmember Spaeth introduced the following Resolution and
moved its adoption:
RESOLUTION #78-194
DIRECTING THE CITY CLERK WITH RESPECT TO THE FILING OF RESOLUTION NO. 78-193
WHEREAS, the City Council of the City of Plymouth has authorized the vacation of that
part of Pineview Lane between the west line of Larch Lane and the south line of
the Soo Line Tracks right-of-way; and,
WHEREAS, the City requires the temporary right to utilize the aforedescribed portion
of said road for public roadway purposes until such time as 49th Avenue North west of
Larch Lane and new Pineview Lane between 49th Avenue North and the Soo Line Tracks
are opened for public use and officially accepted by the City Council;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA as follows:
1. That the City Clerk is directed to not file the resolution vacating the afore -
described portion of Pineview Lane until such time as the following conditions
occur:
a. Fee title to said portionof said road is vested and recorded in the
name of Criterion Homes, Inc. a Minnesota corporation.
b. A valid, recordable temporary easement for public roadway purposes over the
aforedescribed portion of Pineview Lane in a form acceptable to the City
Attorney, is provided the City Attorney for filing with the appropriate
County officials.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Seibold , and upon vote being taken thereon, the
following vo e n aYor t ereo : Mayor Hunt, Councilmembers Hoyt, Neils,__
or Seibold and Spaeth

Whereupon the Resolution was declared duly passed and adopted,
