HomeMy WebLinkAboutCity Council Resolution 1978-193OITY OF PLYMOUTH • Pursuant to due call and notice thereof, a regular meeting of thec�ilttI Council of the City of Plymouth, Minnesota was held on the day of April 192&. The following members were present: Mayor Hunt, Councilmembers Hoyt LNeils, Seibold and Spaeth The following members were absent: None Councilmember Spaeth introduced the following Resolution and moved its adoption: RESOLUTION #78-193 AUTHORIZING THE VACATION OF PINEVIEW LANE BETWEEN THE SOO LINE TRACKS AND LARCH LANE (A-648) WHEREAS, a petition to vacate Pineview Lane between Larch Lane and the south line of the Soo Line Tracks right-of-way has been received by the City Council from the property owners adjacent to Pineview Lane between Larch Lane and the south line of the Soo Line Tracks right-of-way; and, WHEREAS, a public hearing with respect to said vacation was held on April 17, 1978 in accordance with Minnesota Statutes, 412.851, as amended; and. WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of April 17, 1978; and, WHEREAS, the Council did hold a public hearing on April 17, 1978 to inform any and all interested parties relevant to the vacation of Pineview Lane between Larch Lane and the south line of the Soo Line Tracks right-of-way; and, WHEREAS, it was determined by the City Council that with the completion of 49th Avenue North west to Pineview Lane and Pineview Lane, a certain portion of Pineview Lane is not needed for a public street; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA as follows: 1. That that portion of Pineview Lane between the west line of Larch Lane and the South line of the Soo Line Tracks right-of-way be vacated as public roadway. 2. That said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling electric or telephone poles and lines, gas and sewer lines, or water pipes, maines and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to repair, replace, remove or otherwise attend thereto. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Neils , and upon vote being taken thereon, the 0 ow ng vote n avor thereo : Mayor Hunt, Counctlmembers Hoyt, Neils_, Seibold and Spaeth The following vo against ora sta ne one Whereupon the Resolution was declared duly pmed and adopted.
