Pursuant to due call and notice thereof, a special meeting of
the City Council of the City of Plymouth. 5nesota was held on the
27th daffy of Februar�y, 1978 . The following members were
present: Mayor Hunt, eters, Hoyt,—Neils, Seibold and Spaeth

Councilmember Spaeth introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 78-98
REQUEST FOR PAYMENT NO. 6 AND FINAL
PROJECT 1977 STREET IMPROVEMENTS
WHEREAS, the City of Plymouth as Owner and N.D.H., Inc. as contractor have entered
into an agreement for the improvement of Project 1977 Street Improvements, said
agreement being dated June 14, 1977. and
WHEREAS, the Engineer has certified his acceptance of the work and his approval
of the Final Request for Payment,
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:
1. That the original contract amount was $411,157.65; Change Order No. 1
was approved for the additional amount of $11,408.00, making a revised
contract amount of $422,565.65 and the value of the work completed to
date is $391,087.61.
2. That the work performed by the Contractor for Project 1977 Street Improve-
ments and certified to the Council by the Engineer as,acceptable be and the
same is hereby accepted as of February 27, 1978. The Contractor is hereby
released from the contract except as to the conditions of the Performance
Bond, any and all legal rights of the owner, required guarantees and
Correction of Faulty Work after Final Payment.
3. Request for Payment No. 6 and Final in the amount of $41,287.85 to N.D.H.,
Inc. is hereby approved and the City Finance Director is hereby authorized
and directed to pay the same forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by
Council , and upon vote being taken thereon, the
