The following members were present: Mayor Hunt Councilmembers Hoyt, Neils, Seibold and Spaeth The following members were absent: None Councilmember Seibold introduced the following Resolution >nd moved s adoption: • RESOLUTION NO. 78-93 RELATING TO DEFERMENT OF SPECIAL ASSESSMENTS FOR PERSONS 65 YEARS OF AGE OR OLDER AND ESTABLISHING AN INTEREST RATE WHEREAS, the City Council of the City of Plymouth is the official governing body of the City of Plymouth, and WHEREAS, M.S.A. Section 435.193 through 435.195 authorizes the City of Plymouth, upon proper application, to defer the payment of special assess- ments levied against any homestead property owned by a person of 65 years of age or older on January 1 of the assessment year and for whom it would be 10 a hardsh p to make the payments; and WHEREAS, Section 435.194 authorizes the municipality to establish an interest rate to be added to the deferred assessment which shall be payable in addition to the deferred assessment; and VdEREAS, the City Council has determined that the deferral of assessments should be granted to any person otherwise qualified who shall make proper application claiming that: the homestead parcel does not exceed one (1) acre in s",+ and that hir,/her total gross household income did not exceed eight thouiand dollars ($8,000) for the previous calendar year. Income shall be determined in accordance with State Form M-1PR and therefore, constitutes a qualified hardship, provided that claimant has not signed a petition fcr said improvement; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH AS FOLLOW7 : 1. Upon proper application by a person or persons 65 years of age or older for a deferral of special assessments levied against homestead property and upon a showing that the payment of such special assessments would constitute a hardship to the applicant, the payment of such special assessments shall be deferred. 2. An applicant shall be deemec; to qualify for "hardship" status if his or her gr --)ss household income was eight thousand dollars ($8,000) or less for the �:aleidar year preceding the date of the application as deter- mined by Minnesota State Form M-1Pk. Resolution 978-93 Page 2 3. The application of a person, otherwise qualified, will not be granted if such person was a signatory or any petition requesting a public improvement with respect to which the special assessment thereafter levied is included in the requested deferral. 4. Interest at the rate established for the special assessment or assessments being deferred shall be added to the special assessment principal and shall be payable in accordance with the terms and provisions of Minn. Stat. 435.194. Provided, however, that the addition of such interest shall cease upon the date of expiration for the payment of such special assessment as originally set out in the assessmc t roll. BE IT FURTHER RESOLVED that the right of deferment is automatically terminated under Section 435.195 if: 1. The owner dies and the spouse is not otherwise eligible; 2. The property or any part thereof is sold, tra-: 'er-:�d, or subdivided; 3. The property shouia lose its homestead status; or 4. If for any reason the City determines that there would be no hardship to require immediate or partial payment; and BE IT FURTHER RESOLVED that in the event the deferment is terminated, the principal and interest deferred to that date shall be due and payable, and the remaining principal and interest shall be due over the period of time remaining on the original assessment period. BE IT FURTHER RESOLVED that applications for deferments for the year 1979 and thereafter shall be submitted by September 1 of the preceding year.
