HomeMy WebLinkAboutCity Council Resolution 1978-0910 CITY OF PLYMOUTH a Pursuant to due call and notice thereof, a _ special meeting of the City Council of the City of Plymouth, Minnesota, was held on the 27th day of February , 19 78 . The following members were present: Mayor Hunt ng memoers were t** Councilmember Spaeth introduced the following Resolution and moved Its adoption: RESOLUTION NO. 78-91 ADOPTING ASSESSMENT ELMHURST GATEWAY 2ND ADDITION FORMER PLAT 44080 - PARCELS 3900 & 4000 (A-776) (WATER LATERAL FOR EASTERLY PART - PROJECT NO. 334) WHEREAS, we have received a Waiver of Assessment Hearing from the owners of property described as-APlat 44080 - Parcels 3900 & 4000 ''or the proposed assessment of previously installed water lateral facilities. NOW, THEREFORE, BE IT HEREBY RESOLVED -BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the additional special assessment against the lands named therein and each tract of land therein included is hereby found to be benefitted by the proposed improvement in the amount of the assessment levied against it. Such assessment shall be payable in equal annual installments extending over a period of fifteen years, the first of the installments to be payable on or before the first Monday in January 1979 and shall bear interest at the rate of 8% per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1979. To each subsequent installment, when due, shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Finance Director, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and he may, at any time thereafter, pay to the City Finance Director the entire amount of the assessment remaining unpaid with interest accrued to December 31 of the year in which such payment is made. 4. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the proper tax lists of the County and such assessments shall be collected and paid ove- in the same manner as other municipal taxes. *Former 1 J w w Resolution N 78-91 Page 2 5. The total cost of the improvement assessed by this resolution is $1542.45. The motion for the adoption of the foregoing Resolution was duly seconded following Coi 1 ember Seibold , and upon vote being taken thereon, the ol lowing vote vor ereo : Mayor Hunt, Councilmembers Hoyt.
