Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota, was held on t e 6th day of
February , 19 78 . The following members were present: Acting
Mayor Spaeth, Councilmembers Hoyt, Neils and Seibold ,

Councilmember Seibold introduced the following Resolution and moved
s adoption:
RESOLUTION NO. 78-80
AUTHORIZING THE HENNEPIN COUNTY PARK*RESERVE DISTRICT TO ACQUIRE
PROPERTY WITHIN THE NORTH HALF OF SECTIONS 1 AND 2 OF THE CITY OF
PLYMOUTH FOR EXPANSION OF EAGLE LAKE REGIONAL PARK (A-779)
WHEREAS, the Metropolitan Parks and Open Space Commission and the Metropolitan
Council have included the land around Pike Lake and the south shore of Eagle
Lake as a regional park in the Regional Recreation Open Space System Plan
(identified as Eagle Lake Regional Park); and
WHEREAS, the Hennepin County Park Reserve District has been designated as
the implementing agency for the purpose of acquisition, development and
maintenance of said parkland; and
WHEREAS, in accordance with the provisions of Minnesota Statutes Section 398.09
said Hennepin County Park Reserve District is required to obtain the consent of
the City of Plymouth in order that it may proceed to acquire such property; and
WHEREAS, the City's sanitary sewer and water distribution plan provide that a
major portion of the City's trunk sewer and water systems must cross through,
under and adjacent to said land which the Hennepin County Park Reserve District
seeks to acquire; and
WHEREAS, the City wishes to preserve its ability to obtain the necessary ease-
ments and right-of-way over and across said land and to preserve its ability
to recover from such land the fair share of the costs of either currently in
place or required future extensions, including central systems costs; and
WHEREAS, the Hennepin County Park Reserve District Board of Colmissioners
has adopted a formal resolution accepting the provisions stated below con-
tingent on receipt of a letter of assurance from the Metropolitan Council,
or the Parks and Open Space Commission legally acting on its behalf, stating
that land acquisition costs including water and sewer utility costs as set forth
in this resolution are eligible for reimbursement to the District from regional
park funds;
N0W, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that it should and hereby does grant consent to the Hennepin County
Park Reserve District to acquire property within the proposed boundary of Eagle
Lake Regional Park located in the City of Plymouth as illustrrated in Exhibit A,
upon the conditions that:

A. Easements
The Hennepin County Park Reserve District will enter into a
written agreement with the City of Plymouth that at such time
as the City may determine to extend its sanitary sewer and
water system under, across and adjacent to said land the Hen-
nepin County Park Reserve District will provide the mutually
agreed upon easements to the City without cost; and
B. Area Assessments
The Hennepin County Park Reserve District will pay area water
and area sanitary sewer assessments to be levied by the City
of Plymouth which assessments shall be determined as follows:
an area assessment for water currently in the amount of $500
per acre and an area assessment for sanitary sewer currently
in the amount of $500 per acre; and
These area assessments shall in no event exceed $600 per acre
for water or $600 per acre for sanitary sewer or such lesser
amounts which may be in effect at the time the assessments are
levied, whichever figures are the lower. The area within the
park to be assessed shall be that area above the high-water
level of Pike Lake, elevation 875 feet (approximately 152
acres): and
C. REC Charges
The Hennepin County Park Reserve District will pay Residential
Equivalent Connection (REC) charges which will be assessed with
the area assessments. REC charges will be determined by multi-
plying the number of acres in the park above the high-water level
of Pike Lake by the REC charge in effect at the time the area
assessments are levied. The current REC charge is $190 per
REC unit each for water and sanitary sewer; and
D. Water Lateral Assessment
The Hennepin County Park Reserve District agrees that it will pay
a water lateral assessment for the frontage along County Road 1x10
(approximately 2,600 feet) which assessment will be based upon
the cost per foot of an eight inch equivalent water main, based
upon actual project costs, at the time the water utility is con-
structed. Assessment will be for 1/2 of the water main lateral
cost (current cost is approximately $12 per lineal foot); and
E. Sanitary Sewer Lateral Assessment
At the present time, neither party knows the location of the
sanitary sewer trunk main, but both parties agree that in the
design of the utility an effort will be made to maximize the
lateral benefit to the District. The District agrees that it
will pay a sanitary sewer lateral assessment (approximately
4,000 feet) which assessment will be based upon the cost per
foot of a nine inch equivalent sewer line, based upon actual
project costs, at the time the sanitary sewer utility is con-
structed. Assessment will be for 1/2 of the sanitary sewer
lateral cost (current cost is approximately $12 per lineal foot);

F. Design and Engineering

In an effort to reduce cost, the City of Plymouth will design a
sanitary sewer system to serve a park and open space use of this
property. The City will also make a comparison cost of a sanitary
sewer system to serve residential development versus the cost to
serve a park and open space use on this property. The cost com-
parison shall take into account such things as location of pipe,
length of pipe, diameter of pipe, depth of bury and size of lift
station. If this cost comparison shows any savings to the City
from a sanitary sewer system to serve park and open space use versus
a system to serve residential use, the City will credit such savings
to the Hennepin County Park Reserve District.
The Hennepin County Park Reserve District will reimburse the City
of Plymouth for costs incurred in making this cost comparison.
The District will not be obliged to pay for any of the design
and engineering costs of the sanitary sewer system outside park
boundaries above and beyond those contained in normal assessments.
G. The Hennepin County Park Reserve District shall have a voice in the
design of the sanitary sewer system and the location of easements
across the park property and the City of Plymouth shall not unrea-
sonably withhold cooperation in the routing and design of the utility
to meet the reasonable requirements of the Hennepin County Park
Reserve District; and
H. The provisions of this resolution shall become effective contingent
on the receipt by the Hennepin County Park Reserve District of a
letter from the Metropolitan Council, or the Parks and Open Space
Commission legally acting on its behalf, stating that land acquisi-
tion costs including water and sewer utility costs as set forth in
this resolution are eligible for reimbursement to the District from
Metropolitan regional park funds.

HENNEPIN COUNTY, MINNESOTA
Pursuant to due call and notice thereof,'a special meeting
of the City Council of the City of Plymouth, Hennepin County,
Minnesota, was duly held at the City Hall in Plymouth, Minnesota,
on Monday, the 27th day of February, 1978, at 7:30 o'clock P.M.
