Pursuant to due call and notice thereof, a regular meeting of
the City Council of the City of Plymouth, Minnesota was held on the

RESOLUTION NO. 78-74
REQUEST FOR PAYMENT NO. 5 AND FINAL
PROJECT NO. 605 STANDPIPE WATER TANK
WHEREAS, the City of Plymouth as Owner and Brown Minneapolis Tank Company as
Contractor have entered into an agreement for the improvement of Project No. 605
by the construction of Standpipe Water Tank and all necessary appurtenances,
;said Agreement being dated March 9, 1977,
WHEREAS, the Engineer has certified his acceptance of the work and his approval
of the Final Request for Payment,
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:
1. That the original contract amount was $199,000.00; Change Order No. 1
was approved for the additional amount of $1,298.00 and Change Order
No. 2 was approved for the deduction of $850.00, making a revised
contract amount of $199,448.00 and the 'ralue of the work completed
to date is $199,448.00.
2. That the work performed by the Contractor for Project No. 605 and
certified to the Council by the Engineer as acceptable be and the
same is hereby accepted as of February 6, 1978. The Contractor is
hereby released from the contract except as to the conditions of the
Performance Bond, any and all legal rights of the owner, required
guarantees and Correction of Faulty Work after Final Payment.
3. Request for Payment No. 5 and Final in the amount of $2,448.00 to
Brown Minneapolis Tank Company is hereby approved and the City Finance
Director is hereby authorized and directed to pay the same forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Seibold , and upon vote being taken thereon, the
