HomeMy WebLinkAboutCity Council Resolution 1978-004CITY OF PLYHOM Pursuant to due call and notice thereof, a SPECIAL meeting of the City Council of the City of Plymouth, Minnesota, was held on t 9th day of January , 1978 . The following members were present: Ma or Hunt Councilmembers Hot Neils; Seibold and Spaeth The tollaWing Members were absent: one Councilmember Neils introduced the following Resolution and moved its adoption: RESOLUTION No. 78-4 APPROVING CONDITIONAL USE PERMIT FOR SUBDIVISION UNIT PROJECT AND PRELIMINARY PLAT FOR "DEERWOOD MEADOWS" (A-784) WHEREAS, Parklands Development has requested approval of a conditional use permit for a Subdivision Unit Project and preliminary plat for "Deerwood Meadows" located between 44th and 47th Avenues North and between Schmidt Lake and Zachary Lane; and, WHEREAS, the Planning Commission has reviewed said request and recommends their approval; NOW, (HEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that the requests of Parklands Development for approval of a conditional use permit for a Subdivision Unit Project and preliminary plat for "Deerwood Meadows" be granted subject to the following conditions: 1. Redesign to provide north -south street continuity per the considerations of the Plymouth Staff report of December 16, 1977, specifically relating to possible cul-de-sacs on Lot 8, Block 5 and Lot 1, Block 6 at the north end of Cottonwood Lane and specifically relating to Lot 45, Block 2 and Lot 1, Block 8 at the end of 45th Avenue North extended westerly. Further, in said redesign, that petitioner and Marvin H. Anderson Construction redesign in a cooperative venture the alignments of Cottonwood and Balsam Lanes for possible connections north -south in order to avoid possible double inter- sections. 2. Redesign to incorporate the collector trail.corrtdor (60 ft.) per the Plymouth Trail System Plan. 3. Provision of storm water drainage easements over Schmidt Lake to elevation 925 and NB-Pl to elevation 941. NB -P1 site shall retain 9.0 acre feet of storm water storage per the specifications of the Storm Water Drainage Plan. 4. Subdivision Unit Project Open Space and Public Open Space requirements shall be recaluculated upon redesign, but shall be fees -in -lieu for that portion remaining after credit for storm water drainage and the trail corridor. Resolution 078-4 Page 2 5. All private curb cut access to Zachary Lane shall be prohibited. 6. All peripheral lots shall maintain an area of 15,300 sq. ft. or greater. 7. Lompliance with the provisions of the City Engineer's memorandum. B. The Engineer's report be changed to include installation of storm sewer pipe as the answer to storm water drainage from the plat. 9. That the front yard structure setback for lots along 45th Avenue North be the same on the west (petitioner's property) as exists on the east side of the street (within Shorewood Acres), not to exceed 50 ft., specifically Block 4, Lots 1-6 and such lots shall be of comparable width of those lots on the west. 10. That at the time of final plat approval street alignment be shown to cleariy coordinate with Marvin Anderson's plat to the east as recommended by staff. 11. Final plat design shall indicate accelerating and turning lanes on the west side of Zachary Lane at the intersections of 45th and 47th Avenues of this plat. The motion for the adoption of the foregoing Resolution was duly seconded byuncilmembg Seibold , and upon vote being taken thereon, the followuig votedt favor ereo Mayor Hunt, Councilmember Hoyt, Neils, r Sgibald and Spaeth Whereupon the Resolution was declared duly RAR RRR RRf
