The following members were present: ng members were abs Councilman Hunt introduced the following Resolution and moved 5 adoption: RESOLUTION NO. 77-722 AUTHORIZING THE HENNEPIN COUNTY PARK'RESERVE DISTRICT TO ACQUIRE PROPERTY WITHIN THE NORTH HALF OF SECTIONS 1 AND 2 OF THE CITY OF PLYMOUTH FOR EXPANSION OF EAGLE LAKE REGIONAL PARK (A-779) WHEREAS, the Metropolitan Parks and Open Space Commission and the Metropolitan Council have included the land around Pike Lake and the south shore of Eagle Lake as a regional park in the Regional Recreation Open Space System Plan (identified as Eagle Lake Regional Park); and WHEREAS, the Hennepin County Park Reserve District has been designated as the implementing agency for the purpose of acquisition, development and maintenance of said parkland; and WHEREAS, in accordance with the provisions of Minn. Stat. Section 398.09 said Hennepin County Park Reserve District is required to obtain the consent of the City of Plymouth in order that it may proceed to acquire such property; and WHEREAS, the City's sanitary sewer and water distribution plan provide that a major portion of the City's trunk sewer and water systems must cross through, under and adjacent to said land which the Hennepin County Park Reserve District seek to acquire; and WHEREAS, the City wishes to preserve its ability to obtain the necessary easements and right-of-way over and across said land and to preserve its ability to recover from such land its fair share of the costs of either currently in place or required future extensions, including central systems costs; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that it should and hereby does grant consent to the Hennepin County Park Reserve District to acquire property within the proposed boundary of Eagle Lake Regional Park located in the City of Plymouth as illustrated in Exhibit A, upon the conditions that: the H.C.P.R.D. will enter into a written agreement with the City of Plymouth that at such time as the City may determine to extend its sanitary sewer and water system under, across and adjacent to said land the H.C.P.R.D. will provide the required easements to the City without cost; Resolution No. 77-722 Page 2 b. the H.C.P.R.D. will agree to accept the assessments and REC charges levied at such time by the City of Plymouth which assessments shall be levied in the same manner and in the same amount as levied against residential properties in the area assessed for such work after crediting to the District savings that the District and the City determine can be affected by redesigning and reengineering the system attributable to the change in land use; and c. that the H.C.P.R.D. shall reimburse the City of Plymouth for any costs incurred for the redesign and reengineering of the system; and d. the H.C.P.R.D. agrees that such assessments and charges shall include an amount for lateral benefit, area charges and REC charges; and e. that the H.C.P.R.D. shall have a voice in the redesign of the sewer system and the location of easements across the park property and the City of Plymouth shall not unreasonably withhold cooperation in the routing and design of the line to meet the reasonable regyirements of the N.C.P.R.D.; and f. that the Board of H.C.P.R.D. will adopt a formal resolution accepting the within provisions in principle whereupon this resolution will be deemed to have become effective.
