CITY OF PLYMOUTH
Pursuant to due call and notice thereof, a special meeting of the City
Council of. the City of Plymouth. Minnesota, was held on t e 26th day of
September , 19 77 . The following members were present:

Councilman Neils introduced the following Resolution and moved
s adoption:
RESOLUTION NO. 77- 541
ADOPTING ASSESSMENT
PROJECT NO. 610 LANCASTER LANE STORM SEWER
WHEREAS, pursuant to proper notice duly given as required by law, the Council has met
and heard and passed upon all objections to the proposed assessment for the improvement
of 1) The Place Apartments: That part of Lot 1 lying in the East Half of the Southeast
Quarter of Section 13 and lying southerly and westerly of a line described as beginning
at a point in the easterly line of Lot 1 distance 448.63 feet southerly from the most
northerly corner thereof; thence west at right angles 300.0 feet; thence deflect right
760 to the northerly line of Lot 1 and lying northerly of a line described as commencing at
the southwesterly corner of Lot 1; thence. northerly along the westerly line thereof a
distance of 567.33 feet to point of beginning; thence easterly deflect right 980 27' 35"
a distance of 298.33 feet; thence easterly deflect 210 22' a distance of 178.90 feet;
thence easterly to a point on the easterly line of Lot 1 distance 582.15 feet northerly
along said easterly line from the southeast corner thereof and that part of Lot 1 lying
in the west half of the Southwest Quarter, Section 13, Township 118, Range 22 2)Metro-Riley:
Commencing at the southwesterly corner of Lot 1; thence Northerly along the westerly
thereof 567.33 feet; thence deflect right 980 27' 35" distance 298.33 feet; thence
deflect right 210 22' distance 178.90 feet to actual point of beginning; thence deflect
right 780 26' distance 290.79 feet; thence Southerly to a point in the southerly line
of said Lot 1 distance 462.77 feet easterly as measured along the southerly line thereof
to the southwesterly corner thereof; thence easterly along the southerly line thereof 582.15
feet; thence westerly to -beginning. 3) Four Seasons: That part of Lot 1 lying north of
the south 562 feet thereof and the South 562 feet of Lot 1, Block 2, Plymouth Plaza
Fourth Addition all in Section 13, Township 118, Range 22, the property is generally
located on the west side of Lancaster Lane between 36th and 39th Avenues by the
installation of storm sewer and all necessary appurtenances,
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOT
1. Such proposed assessment, a copy of which is attached heretoand made a part hereof, is
hereby accepted and shall constitute the special assessment against the lands named
therein and each tract of land therein included is hereby found to be benefited by the
proposed improvement in the amount of the.assessment levied against it.
2. Such assessment shall be payable in equal annual installments extended over a period
of 10 years, the first of the installments to be payable on or before the
first Monday in January 1978 and shall bear interest at the rate of 8% per annum from
the date of the adoption of this assessment resolution. To the first installment
shall be added interest on the entire assessment from the date of this resolution
until December 31, 1977. To each subsequent installment when due shall be added
interest for one year on all unpaid installments.

3. The owner of any property so assessed may, at any time prior to certification of the
assessment to to the County Finance Director, pay the whole of the assessment on
such property, with interest accrued to the date of payment, to the City Finance
Director, except that no interest shall be charged if the entire assessment is paid
within 30 days from the adoption of this resolution; and he may, at any time
thereafter, pay to the County Finance Director the entire amount of the assessments
remaining unpaid with interest accrued to December 31 of the year in which such payment's
is made.
4. The Clerk shall forthwith transmit a certified duplicate of this assessment to the
County Finance Director to be extended on the proper tax lists of the County and
such assessments shall be collected and paid over in the same manner as other
municipal taxes.
5. The total cost of the improvement assessed by this resolution is $18,033.00.
6. The total cost to be financed by the City is $0.00.
The motion for the adoption of the foregoing resolution was duly seconded by
Councilman Spaeth , and upon vote being taken thereon, the following voted in
Tavor tnereoT: mayor niiae, councilmen Hunt, nelis ana bpaetn.
The following voted against or abstained: None
Whereupon said resolution was declared duly passed and adopted.
