APPROVING APPEAL OF JAMES H. PETERSON FROM DECISION OF THE BOARD OF ZONING ADJUSTMENT
FOR LOT 19, BLOCK 4, IVANHOE MOODS
WHER_AS, James H. Peterson has made application to the City of Plymouth for variances
frau setback regulations of the Plymouth Zoning Ordinance on Lot 19, Block 4 of
Ivanhoe Woods; and,
WHEREAS, the Plymouth Board of Zoning Adjustment has held a hearing on said applica-
tion and on September 13, 1977 voted not to approve said variances; and,
WHEREAS, James H. Peterson has appealed the action of the Board of Zoning Adjustment
to the City Council as provided by City Ordinance; and,
WHEREAS, the City Council has duly heard and considered facts pertinent to said
appeal;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve said variances upon the following
findings:
1. That because of the particular shape and topographical conditions of the specific
parcel of land involved, a particular hardship to the owner will result as dis-
tinguished from a mere inconvenience, if the strict letter of the regulations
were carried out.
2. That the conditions upon which the petition for a variation is based are unique
to the parcel of land for which the variance is sought and are not applicable,
generally to other property within the R-1 zoning classification.
3. That the purpose of the variation is not based exclusively opon a desire to increase
the value or income potential of the parcel land.
4. The alleged difficulty or hardship is caused by this Ordinance and has not been
created by any persons presently having an interest in the parcel of land.
5. That the granting of the variation will not be detrimental to the public welfare
or injurious to other land or improvements in the neighborhood in which the parcel
of land is located, and

6. That the proposed variation will not impair an adequate supply light and
air to adjacent property, or substantially increase the congestion of the public
streets, or increase the danger of fire, or endanger the public safety, or
substantially diminish or impair property values within the neighborhood.
The motion for the adoption of the foregoing Resolution was duly seconded
by Councilman Neils , and upon vote being taken thereon, the

Whereupon the Resolution was declared duly pass pt
