Seibold and Spaeth The following members were sent: None ttt ttt ttt Councilman Spaeth introduced the following Resolution and moved its adoption: RESOLUTION #77-503 APPROVING AMENDED CONCEPT PLAN, PRELIMINARY PLAT AND PRELIMINARY,PLAN FOR RPUD 77-1 FOR CRITERION HOMES OF "CREEKWOOD HILLS" (A-648) WHEREAS, Criterion Homes has requested amended Concept Plan, Preliminary Plat and Preliminary Plan for RPUD 77-1, "Creekwood Hills", a residential plat proposed for 125 single family dwelling lots located at the southwest corner of Larch Lane and the Soo Line Railroad Tracks per plans dated August 19, 1977; and, WHEREAS, the Planning Commission has reviewed said request and recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should, and hereby does, approve the request of Criterion Homes for amended Concept Plan, Preliminary Plat and Preliminary Plat approvals for RPUD 77-1, "Creekwood Hills", a residential plat proposed for 125 single family dwelling lots located at the southwest corner of Larch Lane and the Soo Line Railroad Tracks per plans dated August 19, 1977, subject to the following conditions: 1. Redesign to increase the size of Lots 1-5, Block 1 and Lot 1, Block 2 to 15,500 -sq. ft. to provide on-site transition of non -conventional lot sizes. 2. Developer is required to petition for improvement of Pineview Lane. 3. Compliance with the provisions of the City Engineer's memorandum regarding this project. 4. No private drive access to 49th Avenue North, Pineview Lane or Larch Lane except for Lots 26-31, Block 3. 5. Public Open Space requirements shall be satisfied by trail easement dedication along Larch Lane (34,500 sq. ft.) and payment of fees -in -lieu for the 4.91 acre deficiency. 1 6. Removal of all diseased elm on the site entirely at developer's expense. 7. Erosion and run-off control measures be incorporated per Council Resolution #77-163. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman S aeth and upon vote being taken thereon, the fol owing vote in avor ereof: mayor Hilde_ Councilmen Hunt.
