HomeMy WebLinkAboutCity Council Resolution 1977-489r J CITY OF PLYMOM Pursuant to due call and notice thereof, a s ecial meeting of the Council of the City of Plymouth, Minnesota, was held cn t 12th day September , 19=. The following members were present: City of Councilman Hunt introduced the following Resolution and moved its adoption: RESOLUTION NO. 77- 489 ADOPTING ASSESSMENT CIMARRON PONDS 2ND ADDITION WHEREAS, the Centurion Company, as developers of the Cimarron Ponds 2nd Addition in the City of Plymouth, Minnesota have executed a development contract in which they have agreed to accept sanitary sewer and water area assessments in the amount of $52,750.00. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. Such proposed assessments, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessments against lands named therein, and each tract of land therein included is hereby found to be benefitted by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of five years, the first of the installments to be payable on or before the first Monday in January, 1978 and shall bear interest at the rate of 8% per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December, 1977. To each subsequent installment, when due, shall be added interest for one year on all unpai(I installments. The owner of any property so assessed may, at any time prior to the certifi- cation of the assessment to the County Finance Director, pay the whole of the assessment on such property with interest accrued to the date of payment to the City Treasurer except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and he may, at any time thereafter, pay to the County Finance Director the entire amount of the assessment remaining unpaid with interest accrued to December 31 of the year in which such payment is made. 4. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the proper tax lists of the County and such assessments shall be collected and paid over in the same mannner as other municipal taxes. W Resolution #77-489 Page 2 5. The amount of the assessment levied by this resolution is $52,750.00 (sewer $20,250.00, water $32,500.00). The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Neils , and upon vote being taken thereon the following voted favor t ereo : Mayor Hilde, Councilmen Hunt, Nei)s, Seibold and Spaeth owing voted against or abstained: Whereupon the Resolution was declared duly passed We adopted. -' Rei!
