Councilman Spaeth introduced the following Resolution and moved its adoption: RESOLUTION N0. 77-464 CALLING HEARING ON PROPOSED ASSESSMENT PROJECT NO. 609 REINHARD INDUSTRIAL'PARK ti• ' WHEREAS. by.4 resulution passed by the Council on August 22, 19f f' the City Clerk was directed to prepare a proposed assessment of the cost of improving 12th Avenue from Xenium Lane to approximately 1100 feet east to the.termiftation.•of the.. cul-de-sac within the plat of Reinhard Industrial Park (said property lying south of the Chipago-Northwestern Railroad right-of-way, east of Xeniufi.Lane,'north of the. south side' line of the northwest quarter of the gortheast quarter of Section 34, Township 118,.*' .Range 2k) by the construction of 9 ton bituminous street with concrete curb and gutter, water main, and sanitary Viewer (said sanitary -sewer line being constructed westerly . from the in lace trunk line lying approximately 300 feet east .of .the easterly_b6undary- of said-platg storm sewer and all necessary: appurtenances.' and 4 WHEREAS, the_Clerk, has notified the Council that such.propesed assessment has: been ' completed and.filed in.the office of the City Clerk for public inspection; NOW THEREFORE, BE IT HEREBY RESOLVE•D•BY THE CITY COUNCIL OF�THE CITY OF PLYMOUTH, MINNESOTA: 1. A hearing shall- be held on the- 26th day of, September,` 1977, 1n-Ahe'. Council •Chambers of the City Public Works BuilAing,• 14900 23rd:•Avenue North at 7:.30 p.m. to pass upon the proposed assessment and4at such`time and place all persons owning property affected by such improvement will be gtiven an. opportuni'ty to.be heard with reference to'suth assessment. 2. The City Clerk is -hereby directed to cause a notice.of the hearing, on the -proposed •• assessment to be published once in the official neWSpaper at least two weeks -prior to the hearing and shall state in the notice the total cost of the A mprovement and the City Clerk shall also cause mailed notice to be given -to the owner of each parcel described in the assessment roll. The motion for the adoption of the foregoing Resolution wa, duly seconded by Councilman Neils , and upon vote being taken thereon, the fol owing voted in favor thereof: Councilmen Hunt, Neils and Spaeth The following voted against or abstained: None Vhereupon the Resolution was declared duly passed and adopted. rf+r
