The following members were ent: presMayor Hilde, Councilmen Hunt; Seibold and Spaeth The following members were sent: Councilman Neils Councilman Spaeth introduced the following Resolution and moved its a ption: RESOLUTION NO. 77-446 REQUEST FOR PAYMENT NO. 5 AND FINAL PROJECT NO. 520, 602, 604 & 609 WHEREAS, the City of Plymouth as Owner and Peter Lametti Construction Company, Inc. as Contractor have entered into an agreement for the improvement of Projects 520, 602, 604 & 609 by the construction of sanitary sewers, watermain, streets and all necessary appurtenances, said Agreement being dated June 24, 1976, WHEREAS, the Engineer has certified his acceptance of the work and his approval of the Final Request for Payment, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: I. That the original contract amount was $324,480.49; Change Order No. 1, 2, and 3 were approved in the amount of $7,884.75 making a revised contract amount of $332,365.24 and the value of the work completed to date is $329,467.88. 2. That the work performed by the Contractor for Project No. 520, 602, 604 and 609 and certified to the Council by the Engineer as acceptable be and the same is hereby accepted as of August 22, 1977. The Contractor is hereby released from the contract except as to the conditions of the Performance Bond, any and all legal rights of the owner, required guarantees and. Correction of Faulty Work after Final Payment. 3. Request for Payment No. 5 and Final in the amount of $18,781.10 to , Peter Lametti Construction, Company, Inc. for Project No. 520, 602, 604 and 609 improvments is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith.
