Pursuant to due call and notice thereof, a Reoular meeting of the City Council of the City of Plymouth, Minnesota was a on the 15th day of August , 19 77 . The following members were present: Mayor Hi e, Councilmen Hunt, Neils Seibold and Spaeth The following members were absent: None RRR RRR !RR Councilman Hunt introduced the following Resolution and moved its adoption: RESOLUTION NO. 77- 415 REQUEST FOR PAYMENT NO. 5 AND FINAL PROJECT NO. 116 PINETREE POND STORM SEWER WHEREAS, the City of Plymouth as Owner and Beatson & Kelly Contractors, Inc. as Contractor have entered into an agreement for the improvement of the Pinetree Pond Storm Sewer project by the construction of storm sewers and all necessary appurtenances, said Agreement being dated November 22, 1976, WHEREAS, the Engineer has certified his acceptance of the work and his approval of the Final Request for Payment, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $109,318.70; Change Orders No. 1, 2, and 3 were approved in the amount of $4,760.96 making a revised contract amount of $114,079.66 and the value of the work completed to date is $111,036.98. 2. That the work performed by the Contractor for Project No. 116 and certified to the Council by the Engineer as acceptable be and the same is hereby accepted as of August 15, 1977. The Contractor is hereby released from the contract except as to the conditions of the Performance Bond, any and all legal rights of the owner, required guarantees and Correction of Faulty Work after Final Payment, 3. Request for Payment No. 5 and Final in the amount of $16,994.90 to Beatson & Kelly Contractors, Inc. for Project No. 116, Pinetree Pond Storm Sewer Improvement is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Spaeth , and upon vote being taken thereon, the fol owing vote ir►. avor t ereof: Mayor Hilde, Councilmen Hunt, Neils, Seibold and Spaeth 'Ire following voted against or abstained: one Whereupon the Resolution was declared duly pass pt .
