Pursuant to due call and notice thereof, a'regular meeting of
the City Council of the City of Plymouth, mmesota was Kela on the
15th day of August 19 77 . The following members were
Present: Mayor Aide,_Councilmen Hunt, Neiis, Seibold and Spaeth
The following members were sent: one
Councilman Hunt introduced the following Resolution and moved
its adoption:
RESOLUTION #77-395
SETTING CONDITIONS TO BE MET PRIOR TO RECORDING OF FINAL PLAT OF "MIDDLEMIST 3RD
ADDITION FOR ROBERT MIDDLEMIST (A-718)
WHEREAS, the City Council has approved the final plat and development contract for
"Middlemist 3rd Addition" as requested by Robert Middlemist;
NOW, THEREFORE, BE IT HEREBY PESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should, and 'hereby does, direct the following prior to recording
of said plat:
1. Compliance with provisions of the City Engineer's memorandum regarding this project.
2. Renaming of 4% Avenue North to 40th Place North.
3. Provision of written easement to the City for the balance of Ximines Lane right-
of-way.
4. Park Dedication fees -in -lieu of $1,800.
5. All dead and diseased trees on the property be removed and hauled away at
the owner's expense.
The motion for the adoption of the foregoing Resolution was duly seconded
by Councilman Spaeth , and upon vote being taken thereon, the
fol owing Voted in favorthereof: Mayor Hilde, Councilmen Hunt, Neils,

Whereupon the Resolution was declared duly passed and adopted.
