Pursuant to due call and notice thereof, a. regular meeting of
the City Council of the City of Plymouth, Mesta was IiiWon the

Councilman Seibold introduced the following Resolution and moved
its a'3op—tion:
RESOLUTION #77- 389
APPROVING PRELIMINARY PLAT FOR "CHENEY INDUSTRIAL PARK" FOR CHENEY, INC. (A-750)
WHEREAS, Cheney, Inc. has requested preliminary plat approval of "Cheney Industrial
Park" an industrial plat consisting of eight industrial building lots located at
the northwest corner of Niagara Lane and 28th Avenue North; and,
WHEREAS, the Planning Commission has reviewed said request and recommended approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should, and hereby does, approve the request of Cheney, Inc. for
preliminary plat approval of "Cheney Industrial Park", an industrial plat consisting
of eight industrial building lots located at the northwest corner of Niagara Lane and
28th Avenue North subject to the following conditions:
1. Adjustment of the street aligned along the south plat border (Medina Road) such
that the full 80 ft. right-of-way is within this plat over the westerly 700 ft.
of the plat.. The development contract for any final platting shall reflect
measures to implement construction of the proposed new Medina Road/28th Avenue
i`lorth/Niagara Lane intersection.
2. Development contract provisions limiting private curb cut access to Niagara
Lane to one at the lot line between Lots 1 and 2.
3. Design of that portion of Pond BC -9 within this plat shall be specifically
approved by the City Engineer.
4. The final plat shall reflect a 40 ft. easement for trail purposes along the
entire Niagara Lane frontage.
The motion for the adoption of the foregoing Resolution was duly seconded
by Councilman Hunt , and upon vote being taken thereon, the
following- voted in favor ereof: Mayor Hilde. Councilmen Hunt, Neils,
