HomeMy WebLinkAboutCity Council Resolution 1977-373Cm OF PLYMIM Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on t 15th day of August , 19 77 . 11he following members were present: Mayor i e, Councilmen Hunt Neils, Seibold and Spaeth . s�■■.....� None RAA RRA Councilman Neils introduced the following Resolution and moved its tion: RESOLUTION NO. 77-373 ADOPTING ASSESSMENT GREER'S ORCHARD TRACTS RRR WHEREAS, we have received a waiver of assessment hearing from the owner of property described as all that part of Lot 19, "Greer's Orchard Tracts," lying East of the West 59' and the North 110' of the South 377' measured along the West line of said lot, etc. for previously installed sewer and water laterals, sanitary sewer trunk facilities, and water trunk main pumping and storage facilities. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1.• Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein and each tract of land therein is hereby found to be benefited by the proposed improvement~ in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of 15 years, the first of the installments to be payable on or before the first Monday in January, 1978 and shall bear interest at the rate of 8% per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December, 31, 1977. To each subsequent installment, when due, shall be added interest for one year on a') unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment or such property, With interest accrued to the date of payment, to the City Finance Director, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and he may, at any time thereafter, pay to the County Finance Director the entire amount of the assessment remaining unpaid with interest accrued to December 31 of the year in which such payment is made. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the proper tax lists of the County and such assessments shall be collected and paid over in the same manner as other municipal taxes. 5. The total cost of the improvement assessed by this resolution is $3,242.63. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Hunt , on and upvote being taken thereon, the following voted in favor thereof: Mayor Hilde, Councilmen Hunt, Neils, 5 ibold and Spaeth The owing voted against or abstained: Whereupon the Resolution was declared duly pass adopted. e*• �►� ass
