Councilman Spaeth introduced the following Resolution and moved

AFFIRMING THE DECISION OF THE BOARD OF ZONING ADJUSTMENT ON VARIANCE REQUESTS OF
GERRY FRASER FOR LOT 16, BLOCK 3 AND LOT 16, BLOCK 4
PARKER'S LAKESIDE SECOND ADDITION

WHEREAS, Gerry Fraser has made applications to the City of Plymouth for variances from
setback regulations of the Plymouth Zoning Ordinance on Lot 16, Block 3 and Lot 16,
Block 4, Parker's Lakeside Second Addition; and,
WHEREAS, the Plymouth Board of Zoning Adjustment has held a hearing on said applica-
tions and on July.14, 1977 voted not to approve said variances; and,
WHEREAS, Gerry Fraser has appealed the action of the Board of Zoning Adjustment to
the City Council as provided for by City Ordinance; and,
WHEREAS, the City Council has duly heard and considered facts pertinent to said appeal;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does affirm the decision of the Board of Zoning
Adjustment on these applications for variance and deny the same upon the following
findings:
I. The granting of the petitioned variances will be detrimental to the public wel-
fare and injurious to other land or improvements in the neighborhood in which
the parcels of land are located. The public welfare will be impaired by t1he close
proximity and resulting loss of normal street intersection site distance that
would result from structures being located as proposed coupled with the paved
surface of Third Avenue North being located between 2.7 ft. and 7.3 ft. from the
north right-of-way line.
Injury to other land and improvements will result from a constriction to storm
water drainage in the neighborhood that would result from the structures that
are the basis for the variances.
2. The granting of the petitioned variances will result in danger to the public
safety, particularly traffic safety at Third Avenue North and Quantico Lane and
Third Avenue North -nd Orchid Lane, and substantially diminish and impair property
values within the neighborhood.

The motion for the adoption of the foregoing Resolution was duly seconded
by Ci Hunt , and upon vote being taken thereon, the
