AUTHORIZING THE VACATION OF "TOWN ROAD" BETWEEN SECTIONS 22 AND 23 WITHIN PLYMOUTH
(A-717)
WHEREAS, a petition to vacate Town Road from County Road 154 to its westerly terminus
has been received by the City Council from the property owners adjacent to Town Road
between County Road 154 and its westerly terminus;
AND, WHEREAS, a public hearing with respect to said vacation was held on July 11, 1977
in accordance with Minnesota Statutes, 412.851, as amended;
AND, WHEREAS, a notice of publication of said hearing was published and posted two
weeks prior to the meeting of July 11, 1977;
AND, WHEREAS, the Council did hold a public hearing on July 11, 1977 to inform any
10 and all interested parties relevant to the vacation of Town Road between County Road
154 and its westerly terminus;
AND, WHEREAS, it was determined by the City Council that Town Road is not needed for
a public street;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, as follows:
1. That Town Road from County Road 154 to its westerly terminus at the west line
of the northeast quarter of the southeast quarter of Section 22, Range 22, Township
118 be vacated.
2. That said vacation shall not affect the authority of any person, corporation or
municipality owning or controlling electric or telephone poles and lines, Das
and sewer lines, or water pipes, mains and hydrants thereon or thereunder, to
continue maintaining the same or to enter upon such way or portion thereof vacated
to repair, replace, remove or otherwise attend thereto.
The motion for the adoption of the foregoing Resolution was duly seconded
by Councilman Neils , and upon vote being taken thereon, the
following voted in favorthereof: Mayor Hilde, Councilmen Neil, Seibold
and Spaeth
