The following members were present: Mayor Hilde. Councilmen Hunt Seibold and Spaeth The following members were sent: Councilman Neils Councilman Hunt introduced the following Resolution and moved its ion: RESOLUTION 1177- 324 APPROVING CONDITIONAL USE PERMIT FOR TEMPORARY LAND FILL FOR JEROME P. BEGIN (A-725) WHEREAS, Jerome Begin has requested a conditional use permit to operate a temporary landfill at the south end of Mud Lake; AND, WHEREAS, the Planning Commission has reviewed said request and made recommendations; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should, and hereby does, approve the request of Jerome P. Begin for a conditional use permit to operate a temporary landfill at the south end of Mud Lake subject to the following conditions: 1. Permit shall be for 120 days only with no extensions intended. 2. Fill material shall be limited to trees and clean cover material, not including 10 diseased Elm trees. 3. Deposition in the landfill shall be exclusively by and with equipment and employees -of the petitioner. 4. Petitioner shall provide the City with security in the amount of $2,500 to guarantee compliance with the provisions of this conditional use permit. 5. Concurrence with the State Department of Natural Resources with respect to Shoreland Zoning definitions. 6. Substitution of an earthen dike for the proposed straw bale sedimentation control device. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Seibold , and upon vote being taken thereon, the 10 fol owing voted in favor `- ereof: Mayor Hilde, Councilmen Hunt, Seibold qnapth following voted against orabstained: Nong Whereupon the Resolution was declared duly passed anti adopted. #R# #!R !R#
