Councilman Spaeth introduced the following Resolution and moved

RESOLUTION #77- 323
APPROVING PRELIMINARY PLAT AND CONDITIONAL USE PERMIT FOR SUBDIVISION UNIT PROJECT
FOR MEDICINE LAKE ESTATES, INC. (A-723)
WHEREAS, Medicine Lake Estates, Inc. has requested approval of a preliminary plat
and a conditional use permit for a Subdivision Unit Project for "Medicine Lake
Estates" a plat for 46 residential single family dwelling units located at the north-
west corner of 28th Place and West Medicine Lake Drive;
AND, WHEREAS, the Planning Commission has reviewed said request and recommends its
approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should, and hereby does, approve the requests of Medicine Lake
Estates, Inc. for a preliminary plat and a conditional use permit for a Subdivision
Unit Project approvals for "Medicine Lake Estates", a plat for 46 residential single
family dwelling units located at the northwest corner of 28th Place and West Medicine
Lake Drive subject to the following conditions:
1. Dedication of a storm water drainage easement to the City for all plat area below
elevation 930 ft. to satisfy Subdivision Unit Project and Public Open Space require-
ments. No abatement of area charges for this area shall be considered.
2. Compliance with provisions of the City Engineer's memorandum regarding this project.
3. Compliance with comments of the Bassett's Creek Watershed Commission.
4. Prohibition of private curb cut access to County Road 154.
5. Modification to provide 40 ft. right-of-way from center line on County Road 154.
6. Agreement of Hennepin County in the proposed alignment of 29th Avenue North and
its intersection with West Medicine Lake Drive or realignment as per the County
to intersect West Medicine Lake Drive at the existing 28th Place for access/
egress to West Medicine Lake Drive.
7. Lot 25, Blodk 3 fronting 28th Place be increased to 15,500 sq. ft, in area and
Lot 21, Block 3 be increased in area to be commensurate in size with R.L.S. 701
Tract B.
The motion for the adoption of the foregoing Resolution was duly seconded
by Council an Seibold and upon vote being taken thereon, the
following vote un avor t ereof: Mayor Hilde. Councilmen Hunt, Seibold
owing voted against or abstained:
