CITY OF PLYbDM • Pursuant to due call and notice thereof, a reoular_ meeting of the City Council of the City of Plymouth, Wi—= esn-:a was held on the 20th day of June , 191Z. The following members were Present, Mayor ilde_ Councilmen Hunt Neils Seibold and Spaeth The following members were absent: Hone Councilman Seibold introduced the following Resolution and caved is adoption: RESOLUTION N77-296 APPROVING SITE PLAN FOR RONALD LIBBY FOR LIBBY'S SUPERETTE AND LIQUORS (A-726) WHEREAS, Ronald Libby has requested site plan approval for a 3,000 sq. ft. addition to his building located north of County Road 10 and west of Deerwood Lane for superette and liquor store uses; AND, WHEREAS, the Planning Commission has reviewed said request and recommends approval; NOW, THEREFORE. BE IT HEREBY RESOLVED BY THF CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should, and hereby does, approve the request of Ronal Libby for a 3,000 sq. ft. addition to his building located north of County Road 10 and west of Deerwood Lane for superette and liquor store uses subject to the following conditions: I. Dedication by written easement of 27 ft. additional right-of-way along the entire County Road 10 frontage. 2. Compliance with provisions of the City Engineer's memorandum regarding this project. 3. Prohibition of outside storage of waste or waste containers. 4. Provision of performance security per Code for a 12 -month period. 5. Petitioner shall remove all diseased elm trees from the property. 6. Septic tanks shall be cleaned and pumped as per the recommendation of Coolbroth- Sitton Septic Tanks, Inc. per their letter of May 24, 1977. FURTHER, that a waiver from the provisions of Council Resolution #75-664 be granted based on the combined facts that 1) the action is an addition to an existing facility. 2) the existence of the trunk utility extension project to serve the site (Pike Lake) is in the City's Capital Improvements Program and 3) the certified adequacy of the existing private sanitation facilities. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmen Hunt and upon vote being taken thereon, the follcowing vo �avorreof: Ma or Hilde.
