The following members were present: Mayor Hilde, Councilmen num Neils, Seibold and Spaeth The following members were sent: None MSA 1kAA 4AfF Councilman Spaeth introduced the following Resolution and moved isadoption: RESOLUTION #77- 292 APPROVING CONDITIONAL USE PERMIT FOR SUBDIVISION UNIT PROJECT AND PRELIMINARY PLAT FOR ROLLING ACRES PARTNERSHIP FOR "SEVEN PONDS EAST" (A-232) WHEREAS, Rolling Acres Partnership has requested a conditional use permit for a Subdivision Unit Project and preliminary plat approval of "Seven Ponds East" -a plat for single family development consisting of 29 single family lots located west of Dunkirk Lane at 32nd Avenue North and dated May 25, 1977; AND, WHEREAS, the Planning Commission has reviewed said requests and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should, and hereby does, approve the request of Rolling Acres Partnership for a conditional use permit for a Subdivision Unit Project and preliminary plat of "Seven Ponds East", a plat for single family development consisting of 29 single family lots located west of Dunkirk Lane at 32nd Avenue North and dated May 25, 1977 subject to the following conditions: 1. Compliance with provisions of the City Engineer's memorandum regarding this project including the timing and availability of sanitary sewer. 2. Prohibition of all private access to Dunkirk Lane. 3. Fees -in -lieu payment for Public Open Space of 1.76 acres. 4. Right -^f -way dedication of the 32nd Avenue North street to the wrest is to be constructed at this time with no driveway access. b. Any necessary utilities for continuity to the.plat to the west be improved in 32nd Avanue to the west plat boundary. FURTHER, that the following variances be granted: From Section 7, Subdivision 7, paragraph 2a, to allow variance from the 20 -acre minimum requirement, ."Z:- this 16 -acre Subdivision Unit Project, and from Section 7, Subdivision 7, paragraph 2e ;:o allow payment of fees -in -lieu for 1.6 acres of Subdivision Unit Project Open Space require- ments. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Seibold , and upon vote being taken thereon, the fbll0Wiftg vote avorither'eof: Councilmen Hunt, Neils, Seibold and Spaeth Whereupon the Pesoluiion was^aeclared duly AA•
