The following mebers were Present: Maynr gi1de.'enc_ Men Hud.—Neils Seibold and Spaeth The following members were absent: __ None Councilman Spaeth introduced the following Resolution and moved its adoption: RESOLUTION N77-291 APPROVING CONDITIONAL USE PERMIT FOR SUBDIVISION UNIT PROJECT AND PRELIMINARY PLAT OF "PLYMOUTH CREEKVIEW ADDITION" FOR CARLSON PROPERTIES (A-199) WHEREAS, Carlson Properties has requested a conditional use permit for a Subdivision Unit Project and preliminary plat approval of "Plymouth Creekview Addition", a single family residential plat consisting of 42 lots and one outlot located north of Highway 55 and west of Oakview Lane; AND, WHEREAS, the Planning Commission has reviewed said requests and made recommendations; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COJNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Carlson Properties for a conditional use permit for Subdivision Unit Project and preliminary plat approval of "Plymouth Creekview Addition" a single family residential plat consisting of 42 lots and one outlot, located north of Highway 55 and west of Oakview Lane subject to the following conditions: 1. Compliance with the provisions of the City Engineer's memorandum regarding this project. 2. Dedication of Outlot A to the City of Plymouty by fee title in satisfaction of Subdivision Unit Project Open Space requirements. 3. Final plat provisions for Public Open Space requirements to be fees -in -lieu. 4. Lot 5, Block 1 and Lot 13, Block 5 not be allowed driveway access to 26th Avenue North. 5. Prior to approval of the Final Plat, a realignment of the access to 26th must be accomplished so as to minimize the number of driveways on 26th and provide for closer access to 24th and 2bth Avenue entrances to reach 26th.
